77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to enrolling a public school student in a virtual
1010 education program as an alternative to expulsion.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 37, Education Code, is
1313 amended by adding Section 37.0071 to read as follows:
1414 Sec. 37.0071. VIRTUAL EDUCATION AS ALTERNATIVE TO
1515 EXPULSION. (a) Except as provided by Subsection (b), before a
1616 school district or open-enrollment charter school may expel a
1717 student, the district or school shall consider as an alternative to
1818 expulsion the appropriateness and feasibility of enrolling the
1919 student in a full-time virtual education program through the state
2020 virtual school network under Chapter 30A or another virtual
2121 education program authorized by this code.
2222 (b) Subsection (a) does not apply to a student expelled
2323 under Section 37.007(a), (d), or (e) or 37.0081.
2424 SECTION 2. This Act applies beginning with the 2025-2026
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2025.
