77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prosecution of the offense of fraudulent use or
1010 possession of credit card or debit card information.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 13A, Code of Criminal
1313 Procedure, is amended by adding Article 13A.2551 to read as
1414 follows:
1515 Art. 13A.2551. FRAUDULENT USE OR POSSESSION OF CREDIT CARD
1616 OR DEBIT CARD INFORMATION. An offense under Section 32.315, Penal
1717 Code, may be prosecuted in any county in which the offense was
1818 committed or in the county of residence for any person whose credit
1919 card or debit card information was unlawfully obtained, possessed,
2020 transferred, or used by the defendant.
2121 SECTION 2. Article 38.19(a), Code of Criminal Procedure, is
2222 amended to read as follows:
2323 (a) This article applies to the trial of an offense under
2424 any of the following sections of the Penal Code:
2525 (1) Section 32.21 (Forgery);
2626 (2) Section 32.31 (Credit Card or Debit Card Abuse);
2727 [or]
2828 (3) Section 32.51 (Fraudulent Use or Possession of
2929 Identifying Information); or
3030 (4) Section 32.315 (Fraudulent Use or Possession of
3131 Credit Card or Debit Card Information).
3232 SECTION 3. The changes in law made by this Act apply only to
3333 a criminal proceeding that commences on or after the effective date
3434 of this Act. A criminal proceeding that commenced before the
3535 effective date of this Act is governed by the law in effect on the
3636 date the proceeding commenced, and the former law is continued in
3737 effect for that purpose.
3838 SECTION 4. This Act takes effect September 1, 2025.
