77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to civil liability of a business in connection with
1010 prohibiting concealed handguns on the business premises.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 95A, Civil Practice and Remedies Code,
1313 is amended by adding Section 95A.0002 to read as follows:
1414 Sec. 95A.0002. LIABILITY OF BUSINESS IN CONNECTION WITH
1515 PROHIBITING HANDGUNS. (a) In this section, "license holder" means
1616 a person licensed to carry a handgun under Subchapter H, Chapter
1717 411, Government Code.
1818 (b) A person with control over the premises of a business
1919 who prohibits entry on the premises by a license holder with a
2020 concealed handgun by posting a sign on the premises as described by
2121 Section 30.06, Penal Code, is liable for damages arising from a
2222 criminal act occurring on the premises.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a cause of action that accrues on or after the effective date of
2525 this Act.
2626 SECTION 3. This Act takes effect September 1, 2025.
