97 A BILL TO BE ENTITLED
108 AN ACT
119 relating to the operation of a motor vehicle in a school crossing
1210 zone while intoxicated; increasing a criminal penalty.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Section 49.04, Penal Code, is amended by
1513 amending Subsection (b) and adding Subsection (e) to read as
1614 follows:
1715 (b) Except as provided by Subsections (c), [and] (d), and
1816 (e) and Section 49.09, an offense under this section is a Class B
1917 misdemeanor, with a minimum term of confinement of 72 hours.
2018 (e) If it is shown on the trial of an offense under this
2119 section that at the time of the offense the person was operating the
2220 motor vehicle in a school crossing zone during the time the reduced
2321 speed limit applies to the zone, the offense is a state jail felony.
2422 In this subsection, "school crossing zone" has the meaning assigned
2523 by Section 541.302, Transportation Code.
2624 SECTION 2. The change in law made by this Act applies only
2725 to an offense committed on or after the effective date of this Act.
2826 An offense committed before the effective date of this Act is
2927 governed by the law in effect on the date the offense was committed,
3028 and the former law is continued in effect for that purpose. For
3129 purposes of this section, an offense was committed before the
3230 effective date of this Act if any element of the offense occurred
3331 before that date.
3432 SECTION 3. This Act takes effect September 1, 2025.
