| 13 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 12 | | SECTION 1. Section 49.04, Penal Code, is amended by |
|---|
| 15 | 13 | | amending Subsection (b) and adding Subsection (e) to read as |
|---|
| 16 | 14 | | follows: |
|---|
| 17 | 15 | | (b) Except as provided by Subsections (c), [and] (d), and |
|---|
| 18 | 16 | | (e) and Section 49.09, an offense under this section is a Class B |
|---|
| 19 | 17 | | misdemeanor, with a minimum term of confinement of 72 hours. |
|---|
| 20 | 18 | | (e) If it is shown on the trial of an offense under this |
|---|
| 21 | 19 | | section that at the time of the offense the person was operating the |
|---|
| 22 | 20 | | motor vehicle in a school crossing zone during the time the reduced |
|---|
| 23 | 21 | | speed limit applies to the zone, the offense is a state jail felony. |
|---|
| 24 | 22 | | In this subsection, "school crossing zone" has the meaning assigned |
|---|
| 25 | 23 | | by Section 541.302, Transportation Code. |
|---|
| 26 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 27 | 25 | | to an offense committed on or after the effective date of this Act. |
|---|
| 28 | 26 | | An offense committed before the effective date of this Act is |
|---|
| 29 | 27 | | governed by the law in effect on the date the offense was committed, |
|---|
| 30 | 28 | | and the former law is continued in effect for that purpose. For |
|---|
| 31 | 29 | | purposes of this section, an offense was committed before the |
|---|
| 32 | 30 | | effective date of this Act if any element of the offense occurred |
|---|
| 33 | 31 | | before that date. |
|---|
| 34 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
