88 AN ACT
99 relating to conditions applicable to health benefit plan coverage
1010 of in vitro fertilization procedures.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1366.005, Insurance Code, is amended to
1313 read as follows:
1414 Sec. 1366.005. CONDITIONS APPLICABLE TO COVERAGE. The
1515 coverage offered under Section 1366.003 is required only if:
1616 (1) the patient for the in vitro fertilization
1717 procedure is an individual covered under the group health benefit
1818 plan;
1919 (2) [the fertilization or attempted fertilization of
2020 the patient's oocytes is made only with the sperm of the patient's
2121 spouse;
2222 [(3)] the patient or [and] the patient's spouse has
2323 [have] a history of infertility of at least three [five] continuous
2424 years' duration or the infertility is associated with:
2525 (A) endometriosis;
2626 (B) exposure in utero to diethylstilbestrol
2727 (DES);
2828 (C) blockage of or surgical removal of one or
2929 both fallopian tubes; or
3030 (D) oligospermia;
3131 (3) [(4)] the patient has been unable to attain a
3232 successful pregnancy through any less costly applicable
3333 infertility treatments for which coverage is available under the
3434 group health benefit plan; and
3535 (4) [(5)] the in vitro fertilization procedures are
3636 performed at a medical facility that conforms to the minimal
3737 standards for programs of in vitro fertilization adopted by the
3838 American Society for Reproductive Medicine.
3939 SECTION 2. Section 1366.005, Insurance Code, as amended by
4040 this Act, applies only to a health benefit plan delivered, issued
4141 for delivery, or renewed on or after January 1, 2026. A health
4242 benefit plan delivered, issued for delivery, or renewed before
4343 January 1, 2026, is governed by the law as it existed immediately
4444 before the effective date of this Act, and that law is continued in
4545 effect for that purpose.
4646 SECTION 3. This Act takes effect September 1, 2025.
