12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Chapter 228, Transportation Code, is amended by | |
14 | 14 | adding Section 228.0032 to read as follows: | |
15 | 15 | Sec. 228.0032. PROHIBITION ON COMPENSATION FOR POTENTIAL OR | |
16 | 16 | ACTUAL LOST TOLL PROJECT REVENUE. The department may not require a | |
17 | 17 | local government, as defined by Section 228.0031, to provide | |
18 | 18 | monetary compensation to the department or to otherwise bear the | |
19 | 19 | cost of potential or actual lost toll project revenue resulting | |
20 | 20 | from the construction, improvement, or use of adjacent nontolled | |
21 | 21 | lanes or other road infrastructure that may compete with a toll | |
22 | 22 | project. | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2025. |
