88 AN ACT
99 relating to allowing a bicyclist to treat certain traffic-control
1010 devices as a yield sign.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 551, Transportation Code,
1313 is amended by adding Sections 551.108 and 551.109 to read as
1414 follows:
1515 Sec. 551.108. BICYCLIST APPROACHING STOP SIGN. The
1616 provisions of Sections 544.010(a) and 545.151(a) applicable to stop
1717 signs do not apply to a person operating a bicycle. A person
1818 operating a bicycle shall comply with the provisions of Section
1919 545.153 applicable to yield signs when approaching an intersection
2020 or a railroad crossing with a stop sign.
2121 Sec. 551.109. BICYCLIST APPROACHING CERTAIN
2222 TRAFFIC-CONTROL SIGNALS AND FLASHING SIGNALS. The provisions of
2323 Sections 544.007(d), 544.008(a), and 545.151(a) applicable to a
2424 vehicle facing a steady red signal or a flashing red signal do not
2525 apply to a person operating a bicycle. A person operating a bicycle
2626 shall comply with the provisions of Section 545.153 applicable to
2727 yield signs when approaching an intersection with a steady red
2828 signal or a flashing red signal.
2929 SECTION 2. The change in law made by this Act applies only
3030 to an offense committed on or after the effective date of this Act.
3131 An offense committed before the effective date of this Act is
3232 governed by the law in effect on the date the offense was committed,
3333 and the former law is continued in effect for that purpose. For
3434 purposes of this section, an offense was committed before the
3535 effective date of this Act if any element of the offense occurred
3636 before that date.
3737 SECTION 3. This Act takes effect September 1, 2025.
