| 9 | 9 | | relating to instruction in cardiopulmonary resuscitation and the |

| 10 | 10 | | use of automated external defibrillators for school district, |
|---|
| 11 | 11 | | private school, and open-enrollment charter school employees and |
|---|
| 12 | 12 | | volunteers. |
|---|
| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 14 | 14 | | SECTION 1. Sections 22.902(c) and (e), Education Code, are |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (c) Each school nurse, assistant school nurse, athletic |
|---|
| 17 | 17 | | coach or sponsor, physical education instructor, marching band |
|---|
| 18 | 18 | | director, cheerleading coach, and any other school employee |
|---|
| 19 | 19 | | specified by the commissioner and each student who serves as an |
|---|
| 20 | 20 | | athletic trainer must participate in the instruction in |
|---|
| 21 | 21 | | cardiopulmonary resuscitation and [in] the use of an automated |
|---|
| 22 | 22 | | external defibrillator. A person described by this subsection must |
|---|
| 23 | 23 | | receive and maintain certification in cardiopulmonary |
|---|
| 24 | 24 | | resuscitation and the use of an automated external defibrillator |
|---|
| 25 | 25 | | from the American Heart Association, the American Red Cross, or a |
|---|
| 26 | 26 | | similar nationally recognized association. |
|---|
| 27 | 27 | | (e) [This subsection applies only to a private school that |
|---|
| 28 | 28 | | receives an automated external defibrillator from the agency or |
|---|
| 29 | 29 | | receives funding from the agency to purchase or lease an automated |
|---|
| 30 | 30 | | external defibrillator.] A private school or open-enrollment |
|---|
| 31 | 31 | | charter school shall adopt a policy under which the school makes |
|---|
| 32 | 32 | | available to school employees and volunteers instruction in the |
|---|
| 33 | 33 | | principles and techniques of cardiopulmonary resuscitation and the |
|---|
| 34 | 34 | | use of an automated external defibrillator. The policy must comply |
|---|
| 35 | 35 | | with the requirements prescribed by this section and commissioner |
|---|
| 36 | 36 | | rules adopted under this section, including the requirements |
|---|
| 37 | 37 | | prescribed by Subsection (c). |
|---|
| 38 | 38 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 39 | 39 | | school year. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2025. |
