9 | 9 | relating to parental approval for a student's participation in | |
10 | 10 | human sexuality instruction in public schools. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 28.004, Education Code, is amended by | |
13 | 13 | adding Subsection (i-2) to read as follows: | |
14 | 14 | (i-2) Before a student may be provided with human sexuality | |
15 | 15 | instruction, a school district must obtain the written consent of | |
16 | 16 | the student's parent. A request for written consent under this | |
17 | 17 | subsection: | |
18 | 18 | (1) may not be included with any other notification or | |
19 | 19 | request for written consent provided to the parent, other than the | |
20 | 20 | notice provided under Subsection (i); and | |
21 | 21 | (2) must be provided to the parent not later than the | |
22 | 22 | 14th day before the date on which the human sexuality instruction | |
23 | 23 | begins. | |
24 | 24 | SECTION 2. This Act applies beginning with the 2025-2026 | |
25 | 25 | school year. | |
26 | 26 | SECTION 3. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2025. |
