77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of a person convicted of a misdemeanor
1010 involving moral turpitude to serve in certain roles at a charter
1111 holder or an open-enrollment charter school.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 12.120, Education Code, is amended by
1414 adding Subsection (c) to read as follows:
1515 (c) In this section, "misdemeanor involving moral
1616 turpitude" means a misdemeanor under the following provisions of
1717 the Penal Code:
1818 (1) Section 21.07 (public lewdness);
1919 (2) Section 21.08 (indecent exposure);
2020 (3) Section 25.04 (enticing a child);
2121 (4) Section 38.111 (improper contact with victim);
2222 (5) Section 42.08 (abuse of corpse);
2323 (6) Section 43.02 (prostitution);
2424 (7) Section 43.22 (obscene display or distribution);
2525 (8) Section 43.23 (obscenity); or
2626 (9) Section 43.24 (sale, distribution, or display of
2727 harmful material).
2828 SECTION 2. This Act applies beginning with the 2025-2026
2929 school year.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2025.
