| 9 | 9 | | relating to the eligibility of a person convicted of a misdemeanor |

| 10 | 10 | | involving moral turpitude to serve in certain roles at a charter |

| 11 | 11 | | holder or an open-enrollment charter school. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 12.120, Education Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (c) to read as follows: |
|---|
| 15 | 15 | | (c) In this section, "misdemeanor involving moral |
|---|
| 16 | 16 | | turpitude" means a misdemeanor under the following provisions of |
|---|
| 17 | 17 | | the Penal Code: |
|---|
| 18 | 18 | | (1) Section 21.07 (public lewdness); |
|---|
| 19 | 19 | | (2) Section 21.08 (indecent exposure); |
|---|
| 20 | 20 | | (3) Section 25.04 (enticing a child); |
|---|
| 21 | 21 | | (4) Section 38.111 (improper contact with victim); |
|---|
| 22 | 22 | | (5) Section 42.08 (abuse of corpse); |
|---|
| 23 | 23 | | (6) Section 43.02 (prostitution); |
|---|
| 24 | 24 | | (7) Section 43.22 (obscene display or distribution); |
|---|
| 25 | 25 | | (8) Section 43.23 (obscenity); or |
|---|
| 26 | 26 | | (9) Section 43.24 (sale, distribution, or display of |
|---|
| 27 | 27 | | harmful material). |

| 28 | 28 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 29 | 29 | | school year. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2025. |
