77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to who may request a public hearing from the Texas
1010 Commission on Environmental Quality related to the construction of
1111 a concrete plant.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 382.058(c), Health and Safety Code, is
1414 amended to read as follows:
1515 (c) For purposes of this section, only a representative of a
1616 school, place of worship, licensed day-care center, hospital,
1717 nursing facility, or medical facility or a person [those persons
1818 actually] residing [in a permanent residence] within 880 [440]
1919 yards of the proposed plant may request a hearing under Section
2020 382.056 as a person who may be affected. The commission shall adopt
2121 rules establishing who qualifies as a representative of a school,
2222 place of worship, licensed day-care center, hospital, nursing
2323 facility, or medical facility under this section.
2424 SECTION 2. The change in law made by this Act applies only
2525 to a hearing regarding an application for a permit that is submitted
2626 to the Texas Commission on Environmental Quality on or after the
2727 effective date of the rules described by Section 382.058(c), Health
2828 and Safety Code, as amended by this Act. A hearing regarding an
2929 application for a permit that was submitted to the Texas Commission
3030 on Environmental Quality before the effective date of the rules
3131 described by Section 382.058(c), Health and Safety Code, as amended
3232 by this Act, is governed by the law in effect at the time the
3333 application was filed, and the former law is continued in effect for
3434 that purpose.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2025.
