77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a defense to prosecution and the dismissal of a charge
1010 for the criminal offense of driving with an expired license.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 521.025(d), Transportation Code, is
1313 amended to read as follows:
1414 (d) It is a defense to prosecution under this section that
1515 [if] the person charged produces in court a driver's license:
1616 (1) issued to that person;
1717 (2) appropriate for the type of vehicle operated; and
1818 (3) that was either:
1919 (A) valid on the date [at the time] of the arrest
2020 for the offense; or
2121 (B) expired for not more than 60 days before the
2222 date of the arrest for the offense if the person also produces in
2323 court confirmation that the person had scheduled before the date of
2424 the arrest for the offense an appointment to renew the license
2525 described by this paragraph.
2626 SECTION 2. Section 521.026(a), Transportation Code, is
2727 amended to read as follows:
2828 (a) A judge may dismiss a charge of driving with an expired
2929 license if the defendant remedies this defect within 60 [20]
3030 working days or before the defendant's first court appearance date,
3131 whichever is later.
3232 SECTION 3. The change in law made by this Act applies only
3333 to an offense committed on or after the effective date of this Act.
3434 An offense committed before the effective date of this Act is
3535 governed by the law in effect on the date the offense was committed,
3636 and the former law is continued in effect for that purpose. For
3737 purposes of this section, an offense was committed before the
3838 effective date of this Act if any element of the offense occurred
3939 before that date.
4040 SECTION 4. This Act takes effect September 1, 2025.
