77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the inclusion of a school safety domain for evaluating
1010 districts and campuses under the public school accountability
1111 system.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 39.053(a-1) and (c), Education Code,
1414 are amended to read as follows:
1515 (a-1) The indicators adopted by the commissioner under
1616 Subsection (a) must measure and evaluate school districts and
1717 campuses with respect to:
1818 (1) improving student preparedness for success in:
1919 (A) subsequent grade levels; and
2020 (B) entering the workforce, the military, or
2121 postsecondary education;
2222 (2) reducing, with the goal of eliminating, student
2323 academic achievement differentials among students from different
2424 racial and ethnic groups and socioeconomic backgrounds; [and]
2525 (3) providing a safe learning environment; and
2626 (4) informing parents and the community regarding
2727 campus and district performance.
2828 (c) School districts and campuses must be evaluated based on
2929 four [three] domains of indicators of achievement adopted under
3030 this section that include:
3131 (1) in the student achievement domain, indicators of
3232 student achievement that must include:
3333 (A) for evaluating the performance of districts
3434 and campuses generally:
3535 (i) an indicator that accounts for the
3636 results of assessment instruments required under Sections
3737 39.023(a), (c), and (l), as applicable for the district and campus,
3838 including the results of assessment instruments required for
3939 graduation retaken by a student, aggregated across grade levels by
4040 subject area, including:
4141 (a) for the performance standard
4242 determined by the commissioner under Section 39.0241(a), the
4343 percentage of students who performed satisfactorily on the
4444 assessment instruments, aggregated across grade levels by subject
4545 area; and
4646 (b) for the college readiness
4747 performance standard as determined under Section 39.0241, the
4848 percentage of students who performed satisfactorily on the
4949 assessment instruments, aggregated across grade levels by subject
5050 area; and
5151 (ii) an indicator that accounts for the
5252 results of assessment instruments required under Section
5353 39.023(b), as applicable for the district and campus, including the
5454 percentage of students who performed satisfactorily on the
5555 assessment instruments, as determined by the performance standard
5656 adopted by the agency, aggregated across grade levels by subject
5757 area; and
5858 (B) for evaluating the performance of high school
5959 campuses and districts that include high school campuses,
6060 indicators that account for:
6161 (i) students who satisfy the Texas Success
6262 Initiative (TSI) college readiness benchmarks prescribed by the
6363 Texas Higher Education Coordinating Board under Section 51.334 on
6464 an assessment instrument in reading or mathematics designated by
6565 the coordinating board under that section;
6666 (ii) students who satisfy relevant
6767 performance standards on advanced placement tests or similar
6868 assessments;
6969 (iii) students who earn dual course credits
7070 in the dual credit courses;
7171 (iv) students who enlist in the armed
7272 forces of the United States or the Texas National Guard;
7373 (v) students who earn industry
7474 certifications;
7575 (vi) students admitted into postsecondary
7676 industry certification programs that require as a prerequisite for
7777 entrance successful performance at the secondary level;
7878 (vii) students whose successful completion
7979 of a course or courses under Section 28.014 indicates the student's
8080 preparation to enroll and succeed, without remediation, in an
8181 entry-level general education course for a baccalaureate degree or
8282 associate degree;
8383 (viii) students who successfully met
8484 standards on a composite of indicators that through research
8585 indicates the student's preparation to enroll and succeed, without
8686 remediation, in an entry-level general education course for a
8787 baccalaureate degree or associate degree;
8888 (ix) high school graduation rates, computed
8989 in accordance with standards and definitions adopted in compliance
9090 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
9191 subject to the exclusions provided by Subsections (g), (g-1),
9292 (g-2), (g-3), and (g-4);
9393 (x) students who successfully completed an
9494 OnRamps dual enrollment course;
9595 (xi) students who successfully completed a
9696 practicum or internship approved by the State Board of Education;
9797 (xii) students who are awarded an associate
9898 degree; and
9999 (xiii) students who successfully completed
100100 a program of study in career and technical education;
101101 (2) in the school progress domain, indicators for
102102 effectiveness in promoting student learning, which must include:
103103 (A) for assessment instruments, including
104104 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
105105 percentage of students who met the standard for improvement, as
106106 determined by the commissioner; and
107107 (B) for evaluating relative performance, the
108108 performance of districts and campuses compared to similar districts
109109 or campuses; [and]
110110 (3) in the closing the gaps domain, the use of
111111 disaggregated data to demonstrate the differentials among students
112112 from different racial and ethnic groups, socioeconomic
113113 backgrounds, and other factors, including:
114114 (A) students formerly receiving special
115115 education services;
116116 (B) students continuously enrolled; and
117117 (C) students who are mobile; and
118118 (4) in the school safety domain, indicators for
119119 effectiveness in promoting a safe learning environment, including:
120120 (A) the security of school facilities;
121121 (B) training of faculty and staff to improve
122122 school safety;
123123 (C) instruction to students to improve school
124124 safety; and
125125 (D) the integration of local, state, and federal
126126 resources into school safety programs.
127127 SECTION 2. Section 39.301(d), Education Code, is amended to
128128 read as follows:
129129 (d) Performance on the indicators described by Sections
130130 39.053(c)(1), (2), and (3) [Section 39.053(c)] and Subsections
131131 (c)(3), (4), and (9) of this section must be based on longitudinal
132132 student data that is disaggregated by the bilingual education or
133133 special language program, if any, in which emergent bilingual
134134 students, as defined by Section 29.052, are or former emergent
135135 bilingual students were enrolled. If a student described by this
136136 subsection is not or was not enrolled in specialized language
137137 instruction, the number and percentage of those students shall be
138138 provided.
139139 SECTION 3. This Act applies beginning with the 2025-2026
140140 school year.
141141 SECTION 4. This Act takes effect immediately if it receives
142142 a vote of two-thirds of all the members elected to each house, as
143143 provided by Section 39, Article III, Texas Constitution. If this
144144 Act does not receive the vote necessary for immediate effect, this
145145 Act takes effect September 1, 2025.
