77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an alternate board certification to signify
1010 accreditation within a given specialty in this state and medical
1111 care provided at certain health care facilities by physicians with
1212 an alternate board certification.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 222, Health and Safety Code, is amended
1515 by adding Subchapter D to read as follows:
1616 SUBCHAPTER D. MEDICAL CARE PROVIDED BY PHYSICIANS WITH ALTERNATE
1717 BOARD CERTIFICATIONS AT CERTAIN HEALTH CARE FACILITIES
1818 Sec. 222.101. DEFINITIONS. In this chapter:
1919 (1) "Commission" means the Health and Human Services
2020 Commission.
2121 (2) "Executive commissioner" means the executive
2222 commissioner of the commission.
2323 (3) "Health care facility" means a health care
2424 facility licensed by the commission.
2525 Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH
2626 ALTERNATE BOARD CERTIFICATION TO PRACTICE MEDICINE; FACILITY
2727 LICENSE REVOCATION. (a) A health care facility may not refuse to
2828 accept for board certification purposes a physician's alternate
2929 board certification to practice medicine issued under Section
3030 155.012, Occupations Code, in employing or granting practice or
3131 admitting privileges to the physician for providing medical care to
3232 patients at the facility or otherwise discriminate against the
3333 physician in making an employment or privilege decision based on
3434 the physician's alternate board certification.
3535 (b) The commission shall revoke the license of a health care
3636 facility that violates this section.
3737 (c) The executive commissioner shall adopt rules to
3838 implement this section.
3939 SECTION 2. Subchapter A, Chapter 155, Occupations Code, is
4040 amended by adding Section 155.012 to read as follows:
4141 Sec. 155.012. ALTERNATE BOARD CERTIFICATION FOR CERTAIN
4242 APPLICANTS. (a) The board shall allow alternate board
4343 certifications to practice medicine in this state that:
4444 (1) requires an applicant to satisfy each applicable
4545 eligibility requirement for a board certification under this
4646 chapter except as provided by Subdivision (2); and
4747 (2) does not require an applicant to complete courses
4848 or training on or to satisfy any other requirement, including
4949 obtaining certification, for:
5050 (a) providing a medical treatment or procedure
5151 that is unlawful in the State of Texas.
5252 (b) The board shall adopt rules to implement this
5353 section.
5454 SECTION 3. As soon as practicable after the effective date
5555 of this Act:
5656 (1) the executive commissioner of the Health and Human
5757 Services Commission shall adopt the rules necessary to implement
5858 Subchapter D, Chapter 222, Health and Safety Code, as added by this
5959 Act; and
6060 (2) the Texas Medical Board shall adopt rules to
6161 implement the alternate board certification to signify
6262 accreditation within a given specialty in this state as required by
6363 Section 155.012, Occupations Code, as added by this Act.
6464 SECTION 4. This Act takes effect September 1, 2025.
