11 | 11 | | care provided at certain health care facilities by physicians with |
---|
12 | 12 | | an alternate board certification. |

13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Chapter 222, Health and Safety Code, is amended |
---|
15 | 15 | | by adding Subchapter D to read as follows: |
---|
16 | 16 | | SUBCHAPTER D. MEDICAL CARE PROVIDED BY PHYSICIANS WITH ALTERNATE |
---|
17 | 17 | | BOARD CERTIFICATIONS AT CERTAIN HEALTH CARE FACILITIES |
---|
18 | 18 | | Sec. 222.101. DEFINITIONS. In this chapter: |
---|
19 | 19 | | (1) "Commission" means the Health and Human Services |
---|
20 | 20 | | Commission. |
---|
21 | 21 | | (2) "Executive commissioner" means the executive |
---|
22 | 22 | | commissioner of the commission. |
---|
23 | 23 | | (3) "Health care facility" means a health care |
---|
24 | 24 | | facility licensed by the commission. |
---|
25 | 25 | | Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH |
---|
26 | 26 | | ALTERNATE BOARD CERTIFICATION TO PRACTICE MEDICINE; FACILITY |
---|
27 | 27 | | LICENSE REVOCATION. (a) A health care facility may not refuse to |
---|
28 | 28 | | accept for board certification purposes a physician's alternate |
---|
29 | 29 | | board certification to practice medicine issued under Section |
---|
30 | 30 | | 155.012, Occupations Code, in employing or granting practice or |
---|
31 | 31 | | admitting privileges to the physician for providing medical care to |
---|
32 | 32 | | patients at the facility or otherwise discriminate against the |
---|
33 | 33 | | physician in making an employment or privilege decision based on |
---|
34 | 34 | | the physician's alternate board certification. |
---|
35 | 35 | | (b) The commission shall revoke the license of a health care |
---|
36 | 36 | | facility that violates this section. |
---|
37 | 37 | | (c) The executive commissioner shall adopt rules to |
---|
38 | 38 | | implement this section. |
---|
39 | 39 | | SECTION 2. Subchapter A, Chapter 155, Occupations Code, is |
---|
40 | 40 | | amended by adding Section 155.012 to read as follows: |
---|
41 | 41 | | Sec. 155.012. ALTERNATE BOARD CERTIFICATION FOR CERTAIN |
---|
42 | 42 | | APPLICANTS. (a) The board shall allow alternate board |
---|
43 | 43 | | certifications to practice medicine in this state that: |
---|
44 | 44 | | (1) requires an applicant to satisfy each applicable |
---|
45 | 45 | | eligibility requirement for a board certification under this |
---|
46 | 46 | | chapter except as provided by Subdivision (2); and |
---|
47 | 47 | | (2) does not require an applicant to complete courses |
---|
48 | 48 | | or training on or to satisfy any other requirement, including |
---|
49 | 49 | | obtaining certification, for: |
---|
50 | 50 | | (a) providing a medical treatment or procedure |
---|
51 | 51 | | that is unlawful in the State of Texas. |
---|
52 | 52 | | (b) The board shall adopt rules to implement this |
---|
53 | 53 | | section. |
---|
54 | 54 | | SECTION 3. As soon as practicable after the effective date |
---|
55 | 55 | | of this Act: |
---|
56 | 56 | | (1) the executive commissioner of the Health and Human |
---|
57 | 57 | | Services Commission shall adopt the rules necessary to implement |
---|
58 | 58 | | Subchapter D, Chapter 222, Health and Safety Code, as added by this |
---|
59 | 59 | | Act; and |
---|
60 | 60 | | (2) the Texas Medical Board shall adopt rules to |
---|
61 | 61 | | implement the alternate board certification to signify |
---|
62 | 62 | | accreditation within a given specialty in this state as required by |
---|
63 | 63 | | Section 155.012, Occupations Code, as added by this Act. |
---|
64 | 64 | | SECTION 4. This Act takes effect September 1, 2025. |
