77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the licensing and regulation of hearing instrument
1010 fitters and dispensers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 401.2021, Occupations Code, is amended
1313 to read as follows:
1414 Sec. 401.2021. RULES FOR HEARING INSTRUMENTS. The [With
1515 the assistance of the advisory board and the Hearing Instrument
1616 Fitters and Dispensers Advisory Board, the] commission shall adopt
1717 rules to establish requirements for each sale of a hearing
1818 instrument for purposes of this chapter and Chapter 402. The rules
1919 must:
2020 (1) address:
2121 (A) the information and other provisions
2222 required in each written contract for the purchase of a hearing
2323 instrument;
2424 (B) records that must be retained under this
2525 chapter or Chapter 402; and
2626 (C) guidelines for the 30-day trial period during
2727 which a person may cancel the purchase of a hearing instrument; and
2828 (2) require that the written contract and 30-day trial
2929 period information provided to a purchaser of a hearing instrument
3030 be in plain language designed to be easily understood by the average
3131 consumer.
3232 SECTION 2. Section 402.1021, Occupations Code, is amended
3333 to read as follows:
3434 Sec. 402.1021. RULES FOR HEARING INSTRUMENTS. The [With

3636 Pathologists and Audiologists Advisory Board, the] commission
3737 shall adopt rules to establish requirements for each sale of a
3838 hearing instrument for purposes of this chapter and Chapter 401.
3939 The rules must:
4040 (1) address:
4141 (A) the information and other provisions
4242 required in each written contract for the purchase of a hearing
4343 instrument;
4444 (B) records that must be retained under this
4545 chapter or Chapter 401; and
4646 (C) guidelines for the 30-day trial period during
4747 which a person may cancel the purchase of a hearing instrument; and
4848 (2) require that the written contract and 30-day trial
4949 period information provided to a purchaser of a hearing instrument
5050 be in plain language designed to be easily understood by the average
5151 consumer.
5252 SECTION 3. Section 402.305, Occupations Code, is amended to
5353 read as follows:
5454 Sec. 402.305. CONTINUING EDUCATION EXEMPTIONS. The
5555 department may renew the license of a license holder who does not
5656 comply with the applicable continuing education requirements if the
5757 license holder[:
5858 [(1) was licensed for the first time during the 24
5959 months before the reporting date; or
6060 [(2)] submits proof from an attending physician that
6161 the license holder suffered a serious or disabling illness or
6262 physical disability that prevented compliance with the continuing
6363 education requirements during the 24 months before the reporting
6464 date.
6565 SECTION 4. Section 402.402(a), Occupations Code, is amended
6666 to read as follows:
6767 (a) A licensed hearing instrument fitter and dispenser may
6868 not sell a hearing instrument to a person under 18 years of age
6969 unless the prospective user or a parent or guardian of the
7070 prospective user has presented to the hearing instrument fitter and
7171 dispenser a written statement[,] signed by a licensed physician,
7272 including a physician who specializes [specializing] in diseases of
7373 the ear, that states that the patient's hearing loss has been
7474 medically evaluated and that the patient may be considered a
7575 candidate for a hearing instrument.
7676 SECTION 5. Section 402.402(a), Occupations Code, as amended
7777 by this Act, applies only to conduct that occurs on or after the
7878 effective date of this Act. Conduct that occurs before the
7979 effective date of this Act is governed by the law in effect on the
8080 date the conduct occurred, and the former law is continued in effect
8181 for that purpose.
8282 SECTION 6. This Act takes effect September 1, 2025.
