77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a limitation on the amount of tuition charged by public
1010 institutions of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 54, Education Code, is
1313 amended by adding Section 54.0514 to read as follows:
1414 Sec. 54.0514. LIMITATION ON TOTAL AMOUNT OF TUITION. (a)
1515 In this section, "tuition" includes:
1616 (1) tuition for which the rates are prescribed by this
1717 chapter; and
1818 (2) tuition charged by an institution of higher
1919 education under Section 54.0513 or another law authorizing an
2020 institution to establish tuition rates.
2121 (b) Beginning with the 2026-2027 academic year, the total
2222 amount of tuition charged by an institution of higher education to a
2323 student for an academic year may not exceed the total amount of
2424 tuition that the institution would have charged under this chapter
2525 to a similarly situated student for the 2025-2026 academic year.
2626 This subsection does not apply to tuition for an academic year after
2727 the 2029-2030 academic year and expires September 1, 2030.
2828 (c) The total amount of tuition charged by an institution of
2929 higher education to a student for the 2030-2031 or a later academic
3030 year may not exceed the total amount of tuition that the institution
3131 would have charged under this chapter to a similarly situated
3232 student of the institution for the preceding academic year, based
3333 on the tuition rates in effect for that academic year, as that
3434 amount is adjusted for inflation according to the inflation rate
3535 determined under Subsection (d). The institution may not increase
3636 the amount of tuition charged under this section to a student more
3737 than once in any academic year.
3838 (d) Not later than January 31 of each year beginning
3939 January 31, 2030, or as soon thereafter as practicable, the
4040 Legislative Budget Board shall publish and certify to the governing
4141 board of each institution of higher education the inflation rate to
4242 be used for purposes of this section for the next academic year.
4343 The inflation rate is the percentage increase, if any, as expressed
4444 in decimal form rounded to the nearest thousandth of one percent, in
4545 the consumer price index, as defined by Section 341.201, Finance
4646 Code, for the preceding calendar year as compared to the consumer
4747 price index for the calendar year preceding that calendar year.
4848 (e) For purposes of this section, students are similarly
4949 situated if they share the same residency status, degree program,
5050 course load, course level, tuition exemption status, and other
5151 circumstances affecting the tuition charged to the student.
5252 (f) This section does not ensure that the total amount of
5353 tuition charged to an individual student does not increase based on
5454 a change in the student's residency status, degree program, course
5555 load, course level, tuition exemption status, or other circumstance
5656 affecting the tuition charged to the student.
5757 (g) The Texas Higher Education Coordinating Board may adopt
5858 rules as necessary to administer this section.
5959 SECTION 2. Sections 54.0513(a) and (b), Education Code, are
6060 amended to read as follows:
6161 (a) In addition to amounts that a governing board of an
6262 institution of higher education is authorized to charge as tuition
6363 under the other provisions of this chapter, the governing board[,
6464 under the terms the governing board considers appropriate,] may
6565 charge any student an amount designated as tuition, not to exceed
6666 the amount that enables the institution to comply with Section
6767 54.0514, that the governing board considers necessary for the
6868 effective operation of the institution.
6969 (b) Subject to the limit provided by Subsection (a) on the
7070 amount designated as tuition charged under this section, a [A]
7171 governing board may set a different tuition rate under this section
7272 for each program and course level offered by each institution of
7373 higher education[. A governing board may set a different tuition
7474 rate] as the governing board considers appropriate to increase
7575 graduation rates, encourage efficient use of facilities, or enhance
7676 employee performance.
7777 SECTION 3. Sections 54.0515(e) and (f), Education Code, are
7878 amended to read as follows:
7979 (e) It is the legislature's intent that each institution of
8080 higher education[, as a condition to tuition deregulation under
8181 Section 54.0513,] reasonably implement the following:
8282 (1) each institution shall make satisfactory progress
8383 towards the goals provided in its master plan for higher education
8484 and in "Closing the Gaps," the state's master plan for higher
8585 education, or a successor state master plan; and
8686 (2) each institution shall meet acceptable
8787 performance criteria, including measures such as graduation rates,
8888 retention rates, enrollment growth, educational quality, efforts
8989 to enhance minority participation, opportunities for financial
9090 aid, and affordability.
9191 (f) The committee shall:
9292 (1) meet at the call of either chair;
9393 (2) monitor and regularly report to the legislature on
9494 each institution of higher education's compliance with the
9595 requirements of Subsection (e); and
9696 (3) receive and review information concerning the
9797 affordability and accessibility of higher education[, including
9898 the impact of tuition deregulation].
9999 SECTION 4. This Act applies beginning with tuition charged
100100 by public institutions of higher education for the 2026 fall
101101 semester. Tuition charged by an institution of higher education in
102102 an academic period before that semester is governed by the law in
103103 effect before the effective date of this Act, and the former law is
104104 continued in effect for that purpose.
105105 SECTION 5. This Act takes effect January 1, 2026.
