8	7		AN ACT
9	8		relating to consumer protections against certain medical and health
10	9		care billing by emergency medical services providers.
11	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	11		SECTION 1. Section 773.061, Health and Safety Code, is
13	12		amended by adding Subsection (a-1) to read as follows:
14	13		(a-1) In addition to other permissible actions or penalties
15	14		and regardless of whether an emergency medical services provider is
16	15		directly operated by a governmental entity, the department may
17	16		revoke, suspend, or refuse to renew a license or certificate of the
18	17		provider if the department confirms that the provider has:
19	18		(1) intentionally submitted incorrect information
20	19		required under Section 38.006, Insurance Code; or
21	20		(2) engaged in a pattern of violations of Section
22	21		1271.159, 1275.054, 1301.166, 1551.231, 1575.174, or 1579.112,
23	22		Insurance Code.
24	23		SECTION 2. Section 38.006(b), Insurance Code, is amended to
25	24		read as follows:
26	25		(b) This section expires September 1, 2027 [2025].
27	26		SECTION 3. Sections 1271.159(c) and (g), Insurance Code,
28	27		are amended to read as follows:
29	28		(c) A political subdivision may annually [health
30	29		maintenance organization shall] adjust a rate submitted under
31	30		Section 38.006 [payment required by Subsection (b)(1) each plan
32	31		year] by not more than [increasing the payment by] the lesser of:
33	32		(1) the Medicare Ambulance Inflation Factor; [Index]
34	33		or
35	34		(2) 10 percent of the provider's previous calendar
36	35		year rates.
37	36		(g) This section expires September 1, 2027 [2025].
38	37		SECTION 4. Sections 1275.054(c) and (f), Insurance Code,
39	38		are amended to read as follows:
40	39		(c) A political subdivision may annually [The administrator
41	40		shall] adjust a rate submitted under Section 38.006 [payment
42	41		required by Subsection (b)(1) each plan year] by not more than
43	42		[increasing the payment by] the lesser of:
44	43		(1) the Medicare Ambulance Inflation Factor; [Index]
45	44		or
46	45		(2) 10 percent of the provider's previous calendar
47	46		year rates.
48	47		(f) This section expires September 1, 2027 [2025].
49	48		SECTION 5. Sections 1301.166(c) and (g), Insurance Code,
50	49		are amended to read as follows:
51	50		(c) A political subdivision may annually [An insurer shall]
52	51		adjust a rate submitted under Section 38.006 [payment required by
53	52		Subsection (b)(1) each plan year] by not more than [increasing the
54	53		payment by] the lesser of:
55	54		(1) the Medicare Ambulance Inflation Factor; [Index]
56	55		or
57	56		(2) 10 percent of the provider's previous calendar
58	57		year rates.
59	58		(g) This section expires September 1, 2027 [2025].
60	59		SECTION 6. Sections 1551.231(c) and (f), Insurance Code,
61	60		are amended to read as follows:
62	61		(c) A political subdivision may annually [The administrator
63	62		shall] adjust a rate submitted under Section 38.006 [payment
64	63		required by Subsection (b)(1) each plan year] by not more than
65	64		[increasing the payment by] the lesser of:
66	65		(1) the Medicare Ambulance Inflation Factor; [Index]

71	70		SECTION 7. Sections 1575.174(c) and (f), Insurance Code,
72	71		are amended to read as follows:

82	81		SECTION 8. Sections 1579.112(c) and (f), Insurance Code,
83	82		are amended to read as follows:
84	83		(c) A political subdivision may annually [The administrator
85	84		shall] adjust a rate submitted under Section 38.006 [payment
86	85		required by Subsection (b)(1) each plan year] by not more than
87	86		[increasing the payment by] the lesser of:
88	87		(1) the Medicare Ambulance Inflation Factor; [Index]
89	88		or
90	89		(2) 10 percent of the provider's previous calendar
91	90		year rates.
92	91		(f) This section expires September 1, 2027 [2025].
93	92		SECTION 9. The changes in law made by this Act apply only to
94	93		emergency medical services provided on or after the effective date
95	94		of this Act. Emergency medical services provided before the
96	95		effective date of this Act are governed by the law in effect
97	96		immediately before the effective date of this Act, and that law is
98	97		continued in effect for that purpose.
99	98		SECTION 10. This Act takes effect September 1, 2025.
