76 A BILL TO BE ENTITLED
87 AN ACT
98 relating to consumer protections against certain medical and health
109 care billing by emergency medical services providers.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Section 773.061, Health and Safety Code, is
1312 amended by adding Subsection (a-1) to read as follows:
1413 (a-1) In addition to other permissible actions or penalties
1514 and regardless of whether an emergency medical services provider is
1615 directly operated by a governmental entity, the department may
1716 revoke, suspend, or refuse to renew a license or certificate of the
1817 provider if the department confirms that the provider has:
1918 (1) intentionally submitted incorrect information
2019 required under Section 38.006, Insurance Code; or
2120 (2) engaged in a pattern of violations of Section
2221 1271.159, 1275.054, 1301.166, 1551.231, 1575.174, or 1579.112,
2322 Insurance Code.
2423 SECTION 2. Section 38.006(b), Insurance Code, is amended to
2524 read as follows:
2625 (b) This section expires September 1, 2027 [2025].
2726 SECTION 3. Sections 1271.159(c) and (g), Insurance Code,
2827 are amended to read as follows:
2928 (c) A political subdivision may annually [health
3029 maintenance organization shall] adjust a rate submitted under
3130 Section 38.006 [payment required by Subsection (b)(1) each plan
3231 year] by not more than [increasing the payment by] the lesser of:
3332 (1) the Medicare Ambulance Inflation Factor; [Index]
3433 or
3534 (2) 10 percent of the provider's previous calendar
3635 year rates.
3736 (g) This section expires September 1, 2027 [2025].
3837 SECTION 4. Sections 1275.054(c) and (f), Insurance Code,
3938 are amended to read as follows:
4039 (c) A political subdivision may annually [The administrator
4140 shall] adjust a rate submitted under Section 38.006 [payment
4241 required by Subsection (b)(1) each plan year] by not more than
4342 [increasing the payment by] the lesser of:
4443 (1) the Medicare Ambulance Inflation Factor; [Index]
4544 or
4645 (2) 10 percent of the provider's previous calendar
4746 year rates.
4847 (f) This section expires September 1, 2027 [2025].
4948 SECTION 5. Sections 1301.166(c) and (g), Insurance Code,
5049 are amended to read as follows:
5150 (c) A political subdivision may annually [An insurer shall]
5251 adjust a rate submitted under Section 38.006 [payment required by
5352 Subsection (b)(1) each plan year] by not more than [increasing the
5453 payment by] the lesser of:
5554 (1) the Medicare Ambulance Inflation Factor; [Index]
5655 or
5756 (2) 10 percent of the provider's previous calendar
5857 year rates.
5958 (g) This section expires September 1, 2027 [2025].
6059 SECTION 6. Sections 1551.231(c) and (f), Insurance Code,
6160 are amended to read as follows:
6261 (c) A political subdivision may annually [The administrator
6362 shall] adjust a rate submitted under Section 38.006 [payment
6463 required by Subsection (b)(1) each plan year] by not more than
6564 [increasing the payment by] the lesser of:
6665 (1) the Medicare Ambulance Inflation Factor; [Index]
6766 or
6867 (2) 10 percent of the provider's previous calendar
6968 year rates.
7069 (f) This section expires September 1, 2027 [2025].
7170 SECTION 7. Sections 1575.174(c) and (f), Insurance Code,
7271 are amended to read as follows:
7372 (c) A political subdivision may annually [The administrator
7473 shall] adjust a rate submitted under Section 38.006 [payment
7574 required by Subsection (b)(1) each plan year] by not more than
7675 [increasing the payment by] the lesser of:
7776 (1) the Medicare Ambulance Inflation Factor; [Index]
7877 or
7978 (2) 10 percent of the provider's previous calendar
8079 year rates.
8180 (f) This section expires September 1, 2027 [2025].
8281 SECTION 8. Sections 1579.112(c) and (f), Insurance Code,
8382 are amended to read as follows:
8483 (c) A political subdivision may annually [The administrator
8584 shall] adjust a rate submitted under Section 38.006 [payment
8685 required by Subsection (b)(1) each plan year] by not more than
8786 [increasing the payment by] the lesser of:
8887 (1) the Medicare Ambulance Inflation Factor; [Index]
8988 or
9089 (2) 10 percent of the provider's previous calendar
9190 year rates.
9291 (f) This section expires September 1, 2027 [2025].
9392 SECTION 9. The changes in law made by this Act apply only to
9493 emergency medical services provided on or after the effective date
9594 of this Act. Emergency medical services provided before the
9695 effective date of this Act are governed by the law in effect
9796 immediately before the effective date of this Act, and that law is
9897 continued in effect for that purpose.
9998 SECTION 10. This Act takes effect September 1, 2025.
