| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 154, Occupations Code, is |
|---|
| 13 | 13 | | amended by adding Section 154.007 to read as follows: |
|---|
| 14 | 14 | | Sec. 154.007. COMPLIANCE WITH CERTAIN PUBLIC INFORMATION |
|---|
| 15 | 15 | | REQUESTS. (a) Notwithstanding any other provision of this |
|---|
| 16 | 16 | | subtitle, the board shall comply with a request for public |
|---|
| 17 | 17 | | information made under Section 552.008, Government Code. |
|---|
| 18 | 18 | | (b) When complying with a request for public information |
|---|
| 19 | 19 | | described by Subsection (a), the board may redact: |
|---|
| 20 | 20 | | (1) patient information protected by the federal |
|---|
| 21 | 21 | | Health Insurance Portability and Accountability Act of 1996 (42 |
|---|
| 22 | 22 | | U.S.C. Section 1320d et seq.), unless the request includes |
|---|
| 23 | 23 | | authorization from the patient to disclose the protected |
|---|
| 24 | 24 | | information; and |
|---|
| 25 | 25 | | (2) personally identifiable information of an |
|---|
| 26 | 26 | | individual, except for the name of the individual. |
|---|
| 27 | 27 | | (c) The board shall include with every fulfilled request for |
|---|
| 28 | 28 | | public information described by Subsection (a) a written notice |
|---|
| 29 | 29 | | stating that improper use or distribution of confidential |
|---|
| 30 | 30 | | information constitutes an offense under Section 552.352, |
|---|
| 31 | 31 | | Government Code. |
|---|
| 32 | 32 | | SECTION 2. Section 154.055, Occupations Code, is repealed. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2025. |
