77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to information requested from the Texas Medical Board by a
1010 member, committee, or agency of the legislature.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 154, Occupations Code, is
1313 amended by adding Section 154.007 to read as follows:
1414 Sec. 154.007. COMPLIANCE WITH CERTAIN PUBLIC INFORMATION
1515 REQUESTS. (a) Notwithstanding any other provision of this
1616 subtitle, the board shall comply with a request for public
1717 information made under Section 552.008, Government Code.
1818 (b) When complying with a request for public information
1919 described by Subsection (a), the board may redact:
2020 (1) patient information protected by the federal
2121 Health Insurance Portability and Accountability Act of 1996 (42
2222 U.S.C. Section 1320d et seq.), unless the request includes
2323 authorization from the patient to disclose the protected
2424 information; and
2525 (2) personally identifiable information of an
2626 individual, except for the name of the individual.
2727 (c) The board shall include with every fulfilled request for
2828 public information described by Subsection (a) a written notice
2929 stating that improper use or distribution of confidential
3030 information constitutes an offense under Section 552.352,
3131 Government Code.
3232 SECTION 2. Section 154.055, Occupations Code, is repealed.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
