77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to fiscal impact statements for legislation imposing
1010 mandates on health benefit plan issuers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 314, Government Code, is amended by
1313 adding Section 314.006 to read as follows:
1414 Sec. 314.006. FISCAL IMPACT STATEMENT FOR HEALTH BENEFIT
1515 PLAN MANDATES. (a) In this section:
1616 (1) "Enrollee" means an individual who is enrolled in
1717 a health benefit plan, including a covered dependent.
1818 (2) "Health benefit plan issuer" means an insurer,
1919 health maintenance organization, or other entity authorized to
2020 provide health benefits coverage under the laws of this state.
2121 (3) "Health care provider" means a physician or other
2222 person who is licensed, certified, or otherwise authorized to
2323 provide a health care service in this state.
2424 (b) The board shall prepare a fiscal impact statement for
2525 each bill or joint resolution that requires a health benefit plan
2626 issuer to provide new health benefits, increase payments to health
2727 care providers, or implement new contractual or administrative
2828 requirements.
2929 (c) The fiscal impact statement must estimate the effect of
3030 the bill or joint resolution on health benefit plan issuer
3131 expenditures and on premiums and other costs paid by enrollees.
3232 (d) The fiscal impact statement must be attached to the bill
3333 or joint resolution immediately following:
3434 (1) the fiscal note attached under Section 314.003; or
3535 (2) another statement attached under this chapter.
3636 SECTION 2. Section 314.006, Government Code, as added by
3737 this Act, applies only to a bill or joint resolution filed on or
3838 after the effective date of this Act.
3939 SECTION 3. This Act takes effect September 1, 2025.
