88 AN ACT
99 relating to establishment of the immigration authority delegation
1010 training grant program for local law enforcement agencies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 4, Government Code, is amended
1313 by adding Chapter 426 to read as follows:
1414 CHAPTER 426. IMMIGRATION
1515 Sec. 426.001. DEFINITION. In this chapter, "training
1616 program" means a training program operated by United States
1717 Immigration and Customs Enforcement for training local law
1818 enforcement officers to enforce federal immigration law. The term
1919 includes the immigration authority delegation program and the
2020 immigration authority delegation refresher training program
2121 established under Section 287(g) of the federal Immigration and
2222 Nationality Act (8 U.S.C. Section 1357(g)).
2323 Sec. 426.002. IMMIGRATION AUTHORITY DELEGATION TRAINING
2424 GRANT PROGRAM FOR LOCAL LAW ENFORCEMENT. (a) The office of the
2525 governor shall develop and maintain a grant program that awards
2626 grants for the expenses incurred by a local law enforcement agency
2727 related to the attendance of a law enforcement officer of the agency
2828 in a training program.
2929 (b) A local law enforcement agency may apply to the office
3030 of the governor in the form and manner required by the office of the
3131 governor for a grant under the grant program established by this
3232 section. To qualify for a grant, an applicant must:
3333 (1) apply for preauthorization from the office of the
3434 governor before the law enforcement officer attends the training
3535 program; and
3636 (2) demonstrate that the law enforcement officer who
3737 will attend the training program:
3838 (A) is primarily engaged in making arrests; and
3939 (B) meets all of the United States Immigration
4040 and Customs Enforcement officer selection requirements required to
4141 attend the training program.
4242 Sec. 426.003. GRANT AMOUNT. If the application for a grant
4343 under the grant program established under this section is approved,
4444 the office of the governor shall issue a grant to the applicant in
4545 the amount of:
4646 (1) the salary of the law enforcement officer for:
4747 (A) four weeks, if the officer attends the basic
4848 training course under the training program; or
4949 (B) one week, if the officer attends the
5050 refresher course under the training program;
5151 (2) the costs incurred by the applicant because of the
5252 officer's absence while the officer is attending the training
5353 program, including overtime pay to another officer to fulfill the
5454 duties of the absent officer; and
5555 (3) other expenses the office of the governor
5656 considers necessary for the participation in the training program.
5757 SECTION 2. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2025.
