11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subtitle B, Title 4, Government Code, is amended |
---|
13 | 13 | | by adding Chapter 426 to read as follows: |
---|
14 | 14 | | CHAPTER 426. IMMIGRATION |
---|
15 | 15 | | Sec. 426.001. DEFINITION. In this chapter, "training |
---|
16 | 16 | | program" means a training program operated by United States |
---|
17 | 17 | | Immigration and Customs Enforcement for training local law |
---|
18 | 18 | | enforcement officers to enforce federal immigration law. The term |
---|
19 | 19 | | includes the immigration authority delegation program and the |
---|
20 | 20 | | immigration authority delegation refresher training program |
---|
21 | 21 | | established under Section 287(g) of the federal Immigration and |
---|
22 | 22 | | Nationality Act (8 U.S.C. Section 1357(g)). |
---|
23 | 23 | | Sec. 426.002. IMMIGRATION AUTHORITY DELEGATION TRAINING |
---|
24 | 24 | | GRANT PROGRAM FOR LOCAL LAW ENFORCEMENT. (a) The office of the |
---|
25 | 25 | | governor shall develop and maintain a grant program that awards |
---|
26 | 26 | | grants for the expenses incurred by a local law enforcement agency |
---|
27 | 27 | | related to the attendance of a law enforcement officer of the agency |
---|
28 | 28 | | in a training program. |
---|
29 | 29 | | (b) A local law enforcement agency may apply to the office |
---|
30 | 30 | | of the governor in the form and manner required by the office of the |
---|
31 | 31 | | governor for a grant under the grant program established by this |
---|
32 | 32 | | section. To qualify for a grant, an applicant must: |
---|
33 | 33 | | (1) apply for preauthorization from the office of the |
---|
34 | 34 | | governor before the law enforcement officer attends the training |
---|
35 | 35 | | program; and |
---|
36 | 36 | | (2) demonstrate that the law enforcement officer who |
---|
37 | 37 | | will attend the training program: |
---|
38 | 38 | | (A) is primarily engaged in making arrests; and |
---|
39 | 39 | | (B) meets all of the United States Immigration |
---|
40 | 40 | | and Customs Enforcement officer selection requirements required to |
---|
41 | 41 | | attend the training program. |
---|
42 | 42 | | Sec. 426.003. GRANT AMOUNT. If the application for a grant |
---|
43 | 43 | | under the grant program established under this section is approved, |
---|
44 | 44 | | the office of the governor shall issue a grant to the applicant in |
---|
45 | 45 | | the amount of: |
---|
46 | 46 | | (1) the salary of the law enforcement officer for: |
---|
47 | 47 | | (A) four weeks, if the officer attends the basic |
---|
48 | 48 | | training course under the training program; or |
---|
49 | 49 | | (B) one week, if the officer attends the |
---|
50 | 50 | | refresher course under the training program; |
---|
51 | 51 | | (2) the costs incurred by the applicant because of the |
---|
52 | 52 | | officer's absence while the officer is attending the training |
---|
53 | 53 | | program, including overtime pay to another officer to fulfill the |
---|
54 | 54 | | duties of the absent officer; and |
---|
55 | 55 | | (3) other expenses the office of the governor |
---|
56 | 56 | | considers necessary for the participation in the training program. |
---|
57 | 57 | | SECTION 2. This Act takes effect immediately if it receives |
---|
58 | 58 | | a vote of two-thirds of all the members elected to each house, as |
---|
59 | 59 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
60 | 60 | | Act does not receive the vote necessary for immediate effect, this |
---|
61 | 61 | | Act takes effect September 1, 2025. |
