9 | 9 | | relating to the location of meetings of the board of directors of a |

10 | 10 | | municipal utility district. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter C, Chapter 54, Water Code, is amended |
---|
13 | 13 | | by adding Section 54.103 to read as follows: |
---|
14 | 14 | | Sec. 54.103. MEETINGS. (a) A regular or special meeting of |
---|
15 | 15 | | the board must be held: |
---|
16 | 16 | | (1) if less than 50 percent of the land area inside a |
---|
17 | 17 | | district has been developed, at a publicly accessible location: |
---|
18 | 18 | | (A) inside the district; or |
---|
19 | 19 | | (B) not more than 10 miles outside the district; |
---|
20 | 20 | | or |
---|
21 | 21 | | (2) if at least 50 percent of the land area inside a |
---|
22 | 22 | | district has been developed and except as provided by Subsection |
---|
23 | 23 | | (b), at a publicly accessible location inside the district. |
---|
24 | 24 | | (b) If at least 50 percent of the land area inside a district |
---|
25 | 25 | | has been developed, the board may hold a regular or special meeting |
---|
26 | 26 | | of the board at a publicly accessible location not more than 10 |
---|
27 | 27 | | miles outside the district if five qualified electors petition the |
---|
28 | 28 | | board to designate a location outside the district. |
---|
29 | 29 | | (c) This section does not prohibit the board from holding an |
---|
30 | 30 | | open or closed meeting by telephone conference call or video |
---|
31 | 31 | | conference call in accordance with Chapter 551, Government Code. |
---|
32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2025. |
