77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the location of meetings of the board of directors of a
1010 municipal utility district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 54, Water Code, is amended
1313 by adding Section 54.103 to read as follows:
1414 Sec. 54.103. MEETINGS. (a) A regular or special meeting of
1515 the board must be held:
1616 (1) if less than 50 percent of the land area inside a
1717 district has been developed, at a publicly accessible location:
1818 (A) inside the district; or
1919 (B) not more than 10 miles outside the district;
2020 or
2121 (2) if at least 50 percent of the land area inside a
2222 district has been developed and except as provided by Subsection
2323 (b), at a publicly accessible location inside the district.
2424 (b) If at least 50 percent of the land area inside a district
2525 has been developed, the board may hold a regular or special meeting
2626 of the board at a publicly accessible location not more than 10
2727 miles outside the district if five qualified electors petition the
2828 board to designate a location outside the district.
2929 (c) This section does not prohibit the board from holding an
3030 open or closed meeting by telephone conference call or video
3131 conference call in accordance with Chapter 551, Government Code.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
