| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 372.003, Local Government Code, is | |
| 13 | 13 | amended by adding Subsection (b-2) to read as follows: | |
| 14 | 14 | (b-2) A public improvement project is not subject to the | |
| 15 | 15 | bidding or procurement requirements of Chapter 252 or Chapter 262 | |
| 16 | 16 | if at least one-third of the cost of the improvement is or will be | |
| 17 | 17 | paid or secured by a special assessment levied on property located | |
| 18 | 18 | inside the public improvement district. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2025. |
