77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the members of a school district's local school health
1010 advisory council.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 28.004, Education Code, is amended by
1313 amending Subsection (d) and adding Subsections (d-3) and (d-4) to
1414 read as follows:
1515 (d) The board of trustees shall appoint at least five
1616 members to the local school health advisory council. The board of
1717 trustees:
1818 (1) shall ensure that:
1919 (A) a [A] majority of the members are [must be]
2020 persons who are parents of students enrolled in the district and who
2121 are not employed by the district;
2222 (B) a member described by Paragraph (A) serves [.
2323 One of those members shall serve] as chair or co-chair of the
2424 council; and
2525 (C) subject to Subsection (d-4), at least one
2626 member is a district high school student who has applied for the
2727 position; and
2828 (2) [. The board of trustees also] may appoint one or
2929 more members to the council [persons] from each of the following
3030 groups or a representative from a group other than a group specified
3131 under this subsection:
3232 (A) [(1)] classroom teachers employed by the
3333 district;
3434 (B) [(2)] school counselors certified under
3535 Subchapter B, Chapter 21, employed by the district;
3636 (C) [(3)] school administrators employed by the
3737 district;
3838 (D) [(4) district students;
3939 [(5)] health care professionals licensed or certified
4040 to practice in this state, including medical or mental health
4141 professionals;
4242 (E) [(6)] the business community;
4343 (F) [(7)] law enforcement;
4444 (G) [(8)] senior citizens;
4545 (H) [(9)] the clergy;
4646 (I) [(10)] nonprofit health organizations; and
4747 (J) [(11)] local domestic violence programs.
4848 (d-3) Before appointing a district high school student to
4949 serve on the local school health advisory council under Subsection
5050 (d)(1)(C), the board of trustees shall take reasonable steps to
5151 notify district high school students of the opportunity to serve on
5252 the council and of how to apply for the position, including by
5353 posting signs on district campuses in the cafeterias and other
5454 common areas frequently used by students.
5555 (d-4) The board of trustees shall accept applications for
5656 the position for a district high school student on the local school
5757 health advisory council under Subsection (d)(1)(C) for as long as
5858 the position is vacant and appoint a member to the position as soon
5959 as practicable.
6060 SECTION 2. This Act applies beginning with the 2025-2026
6161 school year.
6262 SECTION 3. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2025.
