9 | 9 | | relating to the members of a school district's local school health |
---|
10 | 10 | | advisory council. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 28.004, Education Code, is amended by |
---|
13 | 13 | | amending Subsection (d) and adding Subsections (d-3) and (d-4) to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (d) The board of trustees shall appoint at least five |
---|
16 | 16 | | members to the local school health advisory council. The board of |
---|
17 | 17 | | trustees: |
---|
18 | 18 | | (1) shall ensure that: |
---|
19 | 19 | | (A) a [A] majority of the members are [must be] |
---|
20 | 20 | | persons who are parents of students enrolled in the district and who |
---|
21 | 21 | | are not employed by the district; |
---|
22 | 22 | | (B) a member described by Paragraph (A) serves [. |
---|
23 | 23 | | One of those members shall serve] as chair or co-chair of the |
---|
24 | 24 | | council; and |
---|
25 | 25 | | (C) subject to Subsection (d-4), at least one |
---|
26 | 26 | | member is a district high school student who has applied for the |
---|
27 | 27 | | position; and |
---|
28 | 28 | | (2) [. The board of trustees also] may appoint one or |
---|
29 | 29 | | more members to the council [persons] from each of the following |
---|
30 | 30 | | groups or a representative from a group other than a group specified |
---|
31 | 31 | | under this subsection: |
---|
32 | 32 | | (A) [(1)] classroom teachers employed by the |
---|
33 | 33 | | district; |
---|
34 | 34 | | (B) [(2)] school counselors certified under |
---|
35 | 35 | | Subchapter B, Chapter 21, employed by the district; |
---|
36 | 36 | | (C) [(3)] school administrators employed by the |
---|
37 | 37 | | district; |
---|
38 | 38 | | (D) [(4) district students; |
---|
39 | 39 | | [(5)] health care professionals licensed or certified |
---|
40 | 40 | | to practice in this state, including medical or mental health |
---|
41 | 41 | | professionals; |
---|
42 | 42 | | (E) [(6)] the business community; |
---|
43 | 43 | | (F) [(7)] law enforcement; |
---|
44 | 44 | | (G) [(8)] senior citizens; |
---|
45 | 45 | | (H) [(9)] the clergy; |
---|
46 | 46 | | (I) [(10)] nonprofit health organizations; and |
---|
47 | 47 | | (J) [(11)] local domestic violence programs. |
---|
48 | 48 | | (d-3) Before appointing a district high school student to |
---|
49 | 49 | | serve on the local school health advisory council under Subsection |
---|
50 | 50 | | (d)(1)(C), the board of trustees shall take reasonable steps to |
---|
51 | 51 | | notify district high school students of the opportunity to serve on |
---|
52 | 52 | | the council and of how to apply for the position, including by |
---|
53 | 53 | | posting signs on district campuses in the cafeterias and other |
---|
54 | 54 | | common areas frequently used by students. |
---|
55 | 55 | | (d-4) The board of trustees shall accept applications for |
---|
56 | 56 | | the position for a district high school student on the local school |
---|
57 | 57 | | health advisory council under Subsection (d)(1)(C) for as long as |
---|
58 | 58 | | the position is vacant and appoint a member to the position as soon |
---|
59 | 59 | | as practicable. |
---|
60 | 60 | | SECTION 2. This Act applies beginning with the 2025-2026 |
---|
61 | 61 | | school year. |
---|
62 | 62 | | SECTION 3. This Act takes effect immediately if it receives |
---|
63 | 63 | | a vote of two-thirds of all the members elected to each house, as |
---|
64 | 64 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
65 | 65 | | Act does not receive the vote necessary for immediate effect, this |
---|
66 | 66 | | Act takes effect September 1, 2025. |
