77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of certain benefits, including applied
1010 behavior analysis, behavior supports, and associated evaluation
1111 services, through telecommunications or information technology
1212 under certain public benefits programs.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 548.0001(b), Government Code, as
1515 effective April 1, 2025, is amended to read as follows:
1616 (b) To the extent permitted by federal law and to the extent
1717 it is cost-effective and clinically effective, as the commission
1818 determines, the commission shall ensure that Medicaid recipients,
1919 child health plan program enrollees, and other individuals
2020 receiving benefits under a public benefits program the commission
2121 or a health and human services agency administers, regardless of
2222 whether receiving benefits through a managed care delivery model or
2323 another delivery model or under a Section 1915(c) waiver program,
2424 have the option to receive services as telemedicine medical
2525 services, telehealth services, or otherwise using
2626 telecommunications or information technology, including the
2727 following services:
2828 (1) preventive health and wellness services;
2929 (2) case management services, including targeted case
3030 management services;
3131 (3) subject to Subsection (c), behavioral health
3232 services;
3333 (4) occupational, physical, and speech therapy
3434 services;
3535 (5) applied behavior analysis, behavior supports, and
3636 associated evaluation services;
3737 (6) nutritional counseling services; and
3838 (7) [(6)] assessment services, including nursing
3939 assessments under the following Section 1915(c) waiver programs:
4040 (A) the community living assistance and support
4141 services (CLASS) waiver program;
4242 (B) the deaf-blind with multiple disabilities
4343 (DBMD) waiver program;
4444 (C) the home and community-based services (HCS)
4545 waiver program; and
4646 (D) the Texas home living (TxHmL) waiver program.
4747 SECTION 2. If before implementing any provision of this Act
4848 a state agency determines that a waiver or authorization from a
4949 federal agency is necessary for implementation of that provision,
5050 the agency affected by the provision shall request the waiver or
5151 authorization and may delay implementing that provision until the
5252 waiver or authorization is granted.
5353 SECTION 3. This Act takes effect September 1, 2025.
