611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to allowing Medicaid managed care organizations to engage
914 in marketing about the availability of certain private health
1015 benefit plan coverage.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1217 SECTION 1. Section 540.0055, Government Code, as effective
1318 April 1, 2025, is amended by adding Subsection (c) to read as
1419 follows:
1520 (c) The marketing guidelines the commission establishes
1621 under this section may not prohibit a Medicaid managed care
1722 organization from:
1823 (1) informing an individual, including a current or
1924 former recipient, about the availability of qualified health plans
2025 offered through an exchange, as the terms "exchange" and "qualified
2126 health plan" are defined by 45 C.F.R. Section 155.20; or
2227 (2) advertising a Medicare Advantage plan or related
2328 benefit offered under Part C of Title XVIII of the Social Security
2429 Act (42 U.S.C. Section 1395w-21 et seq.) at a community enrollment
2530 or other event.
2631 SECTION 2. If before implementing any provision of this Act
2732 a state agency determines that a waiver or authorization from a
2833 federal agency is necessary for implementation of that provision,
2934 the agency affected by the provision shall request the waiver or
3035 authorization and may delay implementing that provision until the
3136 waiver or authorization is granted.
3237 SECTION 3. This Act takes effect September 1, 2025.
