11 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 17 | | SECTION 1. Section 540.0055, Government Code, as effective |
---|
13 | 18 | | April 1, 2025, is amended by adding Subsection (c) to read as |
---|
14 | 19 | | follows: |
---|
15 | 20 | | (c) The marketing guidelines the commission establishes |
---|
16 | 21 | | under this section may not prohibit a Medicaid managed care |
---|
17 | 22 | | organization from: |
---|
18 | 23 | | (1) informing an individual, including a current or |
---|
19 | 24 | | former recipient, about the availability of qualified health plans |
---|
20 | 25 | | offered through an exchange, as the terms "exchange" and "qualified |
---|
21 | 26 | | health plan" are defined by 45 C.F.R. Section 155.20; or |
---|
22 | 27 | | (2) advertising a Medicare Advantage plan or related |
---|
23 | 28 | | benefit offered under Part C of Title XVIII of the Social Security |
---|
24 | 29 | | Act (42 U.S.C. Section 1395w-21 et seq.) at a community enrollment |
---|
25 | 30 | | or other event. |
---|
26 | 31 | | SECTION 2. If before implementing any provision of this Act |
---|
27 | 32 | | a state agency determines that a waiver or authorization from a |
---|
28 | 33 | | federal agency is necessary for implementation of that provision, |
---|
29 | 34 | | the agency affected by the provision shall request the waiver or |
---|
30 | 35 | | authorization and may delay implementing that provision until the |
---|
31 | 36 | | waiver or authorization is granted. |
---|
32 | 37 | | SECTION 3. This Act takes effect September 1, 2025. |
