77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the reimbursement of state employees for groceries
1010 consumed while traveling on official state business.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 660.113(c), Government Code, is amended
1313 to read as follows:
1414 (c) Except as provided by Section 660.1135, a [A] state
1515 agency may not reimburse a state employee for a meal expense
1616 incurred within the employee's designated headquarters unless the
1717 expense is:
1818 (1) mandatory; and
1919 (2) connected with training, a seminar, or a
2020 conference.
2121 SECTION 2. Subchapter F, Chapter 660, Government Code, is
2222 amended by adding Section 660.1135 to read as follows:
2323 Sec. 660.1135. REIMBURSEMENT FOR GROCERIES PURCHASED
2424 WITHIN EMPLOYEE'S DESIGNATED HEADQUARTERS. (a) In this section,
2525 "groceries" means food items sold at a grocery store, supermarket,
2626 or other similar retail establishment.
2727 (b) A state agency may reimburse a state employee as
2828 provided by Subsections (c) and (d) for groceries purchased within
2929 the employee's designated headquarters if:
3030 (1) the grocery purchase date is the day before or the
3131 day the employee travels to conduct official state business; and
3232 (2) the employee consumes the groceries while the
3333 employee is away from the employee's designated headquarters
3434 traveling for official state business.
3535 (c) A state agency may only reimburse a state employee under
3636 this section for the prorated portion of groceries the employee
3737 consumes each day while traveling for official state business.
3838 (d) A purchase under this section is considered a meal
3939 expense for purposes of determining the limit established by the
4040 travel provisions of the General Appropriations Act for meal
4141 expenses under Section 660.112.
4242 (e) A state agency must develop a policy for authorizing
4343 reimbursements under this section before the agency may reimburse a
4444 state employee under this section.
4545 SECTION 3. This Act takes effect September 1, 2025.
