77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of an advisory board to study surface
1010 water and groundwater interaction.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITION. In this Act, "advisory board" means
1313 the Surface Water and Groundwater Interaction Advisory Board.
1414 SECTION 2. SURFACE WATER AND GROUNDWATER INTERACTION
1515 ADVISORY BOARD ESTABLISHED. (a) The Surface Water and Groundwater
1616 Interaction Advisory Board is established and consists of 12
1717 persons as follows:
1818 (1) the executive administrator of the Texas Water
1919 Development Board;
2020 (2) one person to represent the interests of the Texas
2121 Commission on Environmental Quality, recommended by the Texas
2222 Commission on Environmental Quality and appointed jointly by the
2323 chairs of the house natural resources committee and the senate
2424 water, agriculture, and rural affairs committee;
2525 (3) two persons to represent the interests of river
2626 authorities, recommended jointly by the Texas Commission on
2727 Environmental Quality and the Texas Water Development Board and
2828 appointed jointly by the chairs of the house natural resources
2929 committee and the senate water, agriculture, and rural affairs
3030 committee;
3131 (4) two persons to represent the interests of
3232 groundwater conservation districts, recommended jointly by the
3333 Texas Commission on Environmental Quality and the Texas Water
3434 Development Board and appointed jointly by the chairs of the house
3535 natural resources committee and the senate water, agriculture, and
3636 rural affairs committee;
3737 (5) two persons with academic or specialist knowledge
3838 in the area of surface water and groundwater interaction, with one
3939 appointed by the chair of the house natural resources committee and
4040 another appointed by the chair of the senate water, agriculture,
4141 and rural affairs committee;
4242 (6) one person to represent environmental interests or
4343 the interests relating to the interaction of surface water and
4444 groundwater, recommended jointly by the Texas Commission on
4545 Environmental Quality and the Texas Water Development Board and
4646 appointed jointly by the chairs of the house natural resources
4747 committee and the senate water, agriculture, and rural affairs
4848 committee;
4949 (7) the chair of the house natural resources
5050 committee;
5151 (8) the chair of the senate water, agriculture, and
5252 rural affairs committee; and
5353 (9) one person from the office of the governor,
5454 appointed by the governor.
5555 (b) The executive administrator of the Texas Water
5656 Development Board serves as the chair of the advisory board.
5757 SECTION 3. PUBLIC MEETING. The advisory board shall hold at
5858 least one public meeting each year in order to accept comments from
5959 the public on matters studied by the advisory board.
6060 SECTION 4. SURFACE WATER AND GROUNDWATER INTERACTION STUDY.
6161 (a) The advisory board shall study:
6262 (1) the extent to which surface water and groundwater
6363 interact in this state;
6464 (2) challenges arising in this state from the
6565 interaction of surface water and groundwater; and
6666 (3) approaches to mitigating challenges arising in
6767 this state from the interaction of surface water and groundwater.
6868 (b) In conducting the study under this section, the advisory
6969 board shall consult with:
7070 (1) the Texas Commission on Environmental Quality;
7171 (2) groundwater conservation districts; and
7272 (3) river authorities.
7373 SECTION 5. STUDY UPDATES AND REPORT; EXPIRATION OF ACT. (a)
7474 Not later than December 1 of each year, the advisory board shall
7575 submit to the governor, the lieutenant governor, the speaker of the
7676 house of representatives, and each member of the legislature an
7777 annual status report on the progress of the study conducted under
7878 Section 4 of this Act.
7979 (b) Not later than December 1, 2034, the advisory board
8080 shall deliver to the governor, the lieutenant governor, the speaker
8181 of the house of representatives, and each member of the legislature
8282 a final report on the determinations of the advisory board based on
8383 the study conducted under Section 4 of this Act.
8484 (c) The advisory board shall deliver to the governor, the
8585 lieutenant governor, the speaker of the house of representatives,
8686 or a member of the legislature information related to the annual
8787 status report under Subsection (a) of this section or the final
8888 report under Subsection (b) of this section on request.
8989 (d) The advisory board is abolished and this Act expires
9090 January 1, 2035.
9191 SECTION 6. EFFECTIVE DATE. This Act takes effect
9292 immediately if it receives a vote of two-thirds of all the members
9393 elected to each house, as provided by Section 39, Article III, Texas
9494 Constitution. If this Act does not receive the vote necessary for
9595 immediate effect, this Act takes effect September 1, 2025.
