| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article 59.06(g)(1), Code of Criminal Procedure, |
|---|
| 13 | 13 | | is amended to read as follows: |
|---|
| 14 | 14 | | (1) All law enforcement agencies and attorneys |
|---|
| 15 | 15 | | representing the state who receive proceeds or property under this |
|---|
| 16 | 16 | | chapter shall account for the seizure, forfeiture, receipt, and |
|---|
| 17 | 17 | | specific expenditure of all the proceeds and property in an audit, |
|---|
| 18 | 18 | | which is to be performed annually by the commissioners court or |
|---|
| 19 | 19 | | governing body of a municipality, as appropriate. The annual |
|---|
| 20 | 20 | | period of the audit for a law enforcement agency is the fiscal year |
|---|
| 21 | 21 | | of the appropriate county or municipality and the annual period for |
|---|
| 22 | 22 | | an attorney representing the state is the state fiscal year. The |
|---|
| 23 | 23 | | audit must be completed on a form provided by the attorney general |
|---|
| 24 | 24 | | and must include a detailed report and explanation of all |
|---|
| 25 | 25 | | expenditures, including salaries and overtime pay, officer |
|---|
| 26 | 26 | | training, investigative equipment and supplies, and other items. |
|---|
| 27 | 27 | | The audit must also include a detailed report that itemizes all |
|---|
| 28 | 28 | | seizures of proceeds and property under this chapter and that |
|---|
| 29 | 29 | | indicates the date on which the proceeds or property was seized, the |
|---|
| 30 | 30 | | amount of any liquid assets seized, a description of any non-liquid |
|---|
| 31 | 31 | | assets seized, and a description of the final disposition of the |
|---|
| 32 | 32 | | proceeds or property. Certified copies of the audit shall be |
|---|
| 33 | 33 | | delivered by the law enforcement agency or attorney representing |
|---|
| 34 | 34 | | the state to the attorney general not later than the 60th day after |
|---|
| 35 | 35 | | the date on which the annual period that is the subject of the audit |
|---|
| 36 | 36 | | ends. |
|---|
| 37 | 37 | | SECTION 2. The change in law made by this Act in amending |
|---|
| 38 | 38 | | Article 59.06(g)(1), Code of Criminal Procedure, applies to any |
|---|
| 39 | 39 | | audit performed under that subdivision on or after the effective |
|---|
| 40 | 40 | | date of this Act. |

| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
