77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the reporting of proceeds and property from asset
1010 forfeiture proceedings under the Code of Criminal Procedure.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 59.06(g)(1), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (1) All law enforcement agencies and attorneys
1515 representing the state who receive proceeds or property under this
1616 chapter shall account for the seizure, forfeiture, receipt, and
1717 specific expenditure of all the proceeds and property in an audit,
1818 which is to be performed annually by the commissioners court or
1919 governing body of a municipality, as appropriate. The annual
2020 period of the audit for a law enforcement agency is the fiscal year
2121 of the appropriate county or municipality and the annual period for
2222 an attorney representing the state is the state fiscal year. The
2323 audit must be completed on a form provided by the attorney general
2424 and must include a detailed report and explanation of all
2525 expenditures, including salaries and overtime pay, officer
2626 training, investigative equipment and supplies, and other items.
2727 The audit must also include a detailed report that itemizes all
2828 seizures of proceeds and property under this chapter and that
2929 indicates the date on which the proceeds or property was seized, the
3030 amount of any liquid assets seized, a description of any non-liquid
3131 assets seized, and a description of the final disposition of the
3232 proceeds or property. Certified copies of the audit shall be
3333 delivered by the law enforcement agency or attorney representing
3434 the state to the attorney general not later than the 60th day after
3535 the date on which the annual period that is the subject of the audit
3636 ends.
3737 SECTION 2. The change in law made by this Act in amending
3838 Article 59.06(g)(1), Code of Criminal Procedure, applies to any
3939 audit performed under that subdivision on or after the effective
4040 date of this Act.
4141 SECTION 3. This Act takes effect September 1, 2025.
