11 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 15 | | SECTION 1. Article 18B.202(a), Code of Criminal Procedure, |
---|
13 | 16 | | is amended to read as follows: |

14 | 17 | | (a) A district judge may issue an order for the installation |
---|
15 | 18 | | and use of a mobile tracking device only on the application of: |
---|
16 | 19 | | (1) an authorized peace officer; or |
---|
17 | 20 | | (2) a peace officer commissioned by the comptroller. |
---|
18 | 21 | | SECTION 2. This Act takes effect immediately if it receives |
---|
19 | 22 | | a vote of two-thirds of all the members elected to each house, as |
---|
20 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
21 | 24 | | Act does not receive the vote necessary for immediate effect, this |
---|
22 | 25 | | Act takes effect September 1, 2025. |
