69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the authority of a peace officer commissioned by the
912 comptroller to apply for an order authorizing the installation and
1013 use of a mobile tracking device.
1114 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1215 SECTION 1. Article 18B.202(a), Code of Criminal Procedure,
1316 is amended to read as follows:
1417 (a) A district judge may issue an order for the installation
1518 and use of a mobile tracking device only on the application of:
1619 (1) an authorized peace officer; or
1720 (2) a peace officer commissioned by the comptroller.
1821 SECTION 2. This Act takes effect immediately if it receives
1922 a vote of two-thirds of all the members elected to each house, as
2023 provided by Section 39, Article III, Texas Constitution. If this
2124 Act does not receive the vote necessary for immediate effect, this
2225 Act takes effect September 1, 2025.
