611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the approval of a surety bond for a contract authorizing
914 an oversize or overweight vehicle to cross a road or highway.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 623.051(d), Transportation Code, is
1217 amended to read as follows:
1318 (d) Before exercising any right under a contract under this
1419 section, a person must execute with a corporate surety authorized
1520 to do business in this state a surety bond in an amount determined
1621 by the commission to compensate for the cost of maintenance and
1722 repairs as provided by this section. The bond must be approved by
1823 the Texas Department of Transportation [comptroller and the
1924 attorney general] and must be conditioned on the person fulfilling
2025 the obligations of the contract.
2126 SECTION 2. Section 623.052(b), Transportation Code, is
2227 amended to read as follows:
2328 (b) Before a person may operate a vehicle under this
2429 section, the person must:
2530 (1) contract with the Texas Department of
2631 Transportation to indemnify the Texas Department of Transportation
2732 for the cost of the maintenance and repair for damage caused by a
2833 vehicle crossing that part of the highway; and
2934 (2) execute an adequate surety bond to compensate for
3035 the cost of maintenance and repair, approved by the Texas
3136 Department of Transportation [comptroller and the attorney
3237 general], with a corporate surety authorized to do business in this
3338 state, conditioned on the person fulfilling each obligation of the
3439 agreement.
3540 SECTION 3. The changes in law made by this Act apply only to
3641 the approval of a surety bond on or after the effective date of this
3742 Act.
3843 SECTION 4. This Act takes effect immediately if it receives
3944 a vote of two-thirds of all the members elected to each house, as
4045 provided by Section 39, Article III, Texas Constitution. If this
4146 Act does not receive the vote necessary for immediate effect, this
4247 Act takes effect September 1, 2025.
