11+ SENATE JOINT RESOLUTION
712 proposing a constitutional amendment requiring the denial of bail
813 for an illegal alien charged with an offense punishable as a felony.
914 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. This joint resolution shall be known as
1116 Jocelyn's Law.
1217 SECTION 2. Article I, Texas Constitution, is amended by
1318 adding Section 11e to read as follows:
1419 Sec. 11e. (a) In this section, "illegal alien" means a
1520 person who:
1621 (1) entered the United States without inspection or at
1722 any time or place other than as designated by the United States
1823 attorney general; or
1924 (2) was admitted as a nonimmigrant and, before the
2025 date of the commission of the offense, had failed to maintain the
2126 nonimmigrant status under which the alien was admitted or to which
2227 the status was changed under applicable federal immigration law, or
2328 to comply with the conditions of the person's status.
2429 (b) An illegal alien who is accused of committing an offense
2530 punishable as a felony shall be denied bail pending trial if a judge
2631 or magistrate determines after a hearing that probable cause exists
2732 to believe that the person engaged in the conduct constituting the
2833 offense.
2934 SECTION 3. This proposed constitutional amendment shall be
3035 submitted to the voters at an election to be held November 4, 2025.
3136 The ballot shall be printed to permit voting for or against the
3237 proposition: "The constitutional amendment requiring the denial of
3338 bail for an illegal alien charged with an offense punishable as a
3439 felony."
