1713 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1814 SECTION 1. Article III, Texas Constitution, is amended by
1915 adding Section 68 to read as follows:
2016 Sec. 68. (a) The legislature shall establish the Dementia
2117 Prevention and Research Institute of Texas to:
2218 (1) award grants to institutions of learning, advanced
2319 medical research facilities, public or private persons, and
2420 collaboratives in this state to provide money for:
2521 (A) research into the causes of, means of
26- prevention of, and treatment and rehabilitation for dementia,
27- Alzheimer's disease, Parkinson's disease, and related disorders;
22+ prevention of, and treatment and rehabilitation for dementia and
23+ related disorders;
2824 (B) research, including translational research,
2925 to develop therapies, protocols, medical pharmaceuticals, or
3026 procedures for the substantial mitigation of the symptoms of
31- dementia, Alzheimer's disease, Parkinson's disease, and related
27+ dementia and related disorders;
28+ (C) facilities, equipment, and other costs
29+ related to research on dementia and related disorders; and
30+ (D) prevention programs and strategies to
31+ mitigate the detrimental health impacts of dementia and related
3232 disorders;
33- (C) facilities, equipment, and other costs
34- related to research on dementia, Alzheimer's disease, Parkinson's
35- disease, and related disorders; and
36- (D) prevention programs and strategies to
37- mitigate the detrimental health impacts of dementia, Alzheimer's
38- disease, Parkinson's disease, and related disorders;
3933 (2) support institutions of learning and advanced
4034 medical research facilities and collaboratives in this state in all
4135 stages of:
42- (A) discovering the causes of dementia,
43- Alzheimer's disease, Parkinson's disease, and related disorders;
36+ (A) discovering the causes of dementia and
37+ related disorders;
4438 (B) developing therapies, protocols, medical
4539 pharmaceuticals, or procedures for the substantial mitigation of
46- the symptoms of dementia, Alzheimer's disease, Parkinson's disease,
47- and related disorders from laboratory research to clinical trials;
48- and
40+ the symptoms of dementia and related disorders from laboratory
41+ research to clinical trials; and
4942 (C) developing programs to address access to
50- advanced treatment for dementia, Alzheimer's disease, Parkinson's
51- disease, and related disorders; and
43+ advanced treatment for dementia and related disorders; and
5244 (3) establish the appropriate standards and oversight
5345 bodies to ensure the proper use of funding authorized under this
5446 section, including facilities development.
5547 (b) The members of the governing body and any other
5648 decision-making body of the Dementia Prevention and Research
5749 Institute of Texas may serve six-year terms.
5850 (c) The Dementia Prevention and Research Fund is
5951 established as a special fund in the state treasury outside the
6052 general revenue fund to be administered by the Dementia Prevention
6153 and Research Institute of Texas. The comptroller of public
6254 accounts shall credit to general revenue interest due to the fund.
6355 (c-1) On January 1, 2026, the comptroller shall transfer $3
6456 billion from this state's general revenue fund to the Dementia
6557 Prevention and Research Fund. The transfer made under this
6658 subsection is not an appropriation of state tax revenues for the
6759 purposes of Section 22, Article VIII, of this constitution. This
6860 subsection expires January 1, 2029.
6961 (d) The Dementia Prevention and Research Fund consists of:
7062 (1) money transferred to the fund under this section;
7163 (2) money the legislature appropriates, credits, or
7264 transfers to the fund; and
7365 (3) gifts and grants, including grants from the
7466 federal government, and other donations received for the fund.
7567 (e) Notwithstanding any other provision of this
7668 constitution, the Dementia Prevention and Research Institute of
7769 Texas, as established by general law, may use money in the Dementia
7870 Prevention and Research Fund only for the purpose of funding:
79- (1) grants for research on dementia, Alzheimer's
80- disease, Parkinson's disease, and related disorders, research
81- facilities, and research opportunities in this state:
71+ (1) grants for research on dementia and related
72+ disorders, research facilities, and research opportunities in this
73+ state:
8274 (A) for the prevention, treatment, and
83- rehabilitation of dementia, Alzheimer's disease, Parkinson's
84- disease, and related disorders and the mitigation of the incidence
85- of and detrimental health impacts from dementia, Alzheimer's
86- disease, Parkinson's disease, and related disorders; and
75+ rehabilitation of dementia and related disorders and the mitigation
76+ of the incidence of and detrimental health impacts from dementia
77+ and related disorders; and
8778 (B) to develop therapies, protocols, medical
8879 pharmaceuticals, or procedures for the substantial mitigation of
89- the symptoms of dementia, Alzheimer's disease, Parkinson's disease,
90- and related disorders;
80+ the symptoms of dementia and related disorders;
9181 (2) the purchase, construction, or renovation,
9282 subject to the institute's approval, of facilities by or on behalf
9383 of a state agency or grant recipient; and
9484 (3) the institute's operation.
9585 (f) Not including any unspent money appropriated to the
9686 Dementia Prevention and Research Institute of Texas carried forward
9787 from the preceding state fiscal year, the legislature may
9888 appropriate not more than $300 million from the Dementia Prevention
9989 and Research Fund to the institute for a state fiscal year.
10090 (g) Before the Dementia Prevention and Research Institute
10191 of Texas may award a grant authorized under this section, the grant
10292 recipient must have available an unexpended amount of money equal
10393 to one-half of the grant amount dedicated to the research specified
10494 in the grant proposal.
10595 (h) The reasonable expenses of managing the assets of the
10696 Dementia Prevention and Research Fund shall be paid from the fund.
10797 SECTION 2. This proposed constitutional amendment shall be
10898 submitted to the voters at an election to be held November 4, 2025.
10999 The ballot shall be printed to permit voting for or against the
110100 proposition: "The constitutional amendment providing for the
111101 establishment of the Dementia Prevention and Research Institute of
112102 Texas, establishing the Dementia Prevention and Research Fund to
113103 provide money for research on and prevention and treatment of
114- dementia, Alzheimer's disease, Parkinson's disease, and related
115- disorders in this state, and transferring to that fund $3 billion
116- from state general revenue."
