77 A JOINT RESOLUTION
88 rescinding the automatic rescission of certain applications made by
99 the Texas Legislature to the United States Congress to call a
1010 national convention under Article V of the United States
1111 Constitution for proposing any amendment to that constitution.
1212 WHEREAS, The 85th Legislature of the State of Texas, Regular
1313 Session, 2017, enacted S.J.R. No. 38 to officially rescind, repeal,
1414 revoke, cancel, void, and nullify certain applications from Texas
1515 legislatures prior to the 85th Legislature, Regular Session, 2017,
1616 that apply to the United States Congress for the calling of a
1717 convention under Article V of the United States Constitution; and
1818 WHEREAS, S.J.R. No. 38 additionally provided that any
1919 application to the United States Congress for the calling of a
2020 convention under Article V of the United States Constitution that
2121 is submitted by the Texas Legislature during or after the Regular
2222 Session of the 85th Legislature will be automatically rescinded,
2323 repealed, revoked, canceled, voided, and nullified if the
2424 applicable convention is not called on or before the eighth
2525 anniversary of the date the last legislative vote is taken on the
2626 application; now, therefore, be it
2727 RESOLVED, That the 89th Legislature of the State of Texas,
2828 Regular Session, 2025, hereby officially rescinds, repeals,
2929 revokes, cancels, voids, and nullifies the provision of S.J.R.
3030 No. 38 that provided for the automatic rescission, repeal,
3131 revocation, cancellation, voiding, and nullification of any
3232 application from the Texas Legislature after the eighth anniversary
3333 of the date the last legislative vote was taken on the application;
3434 and, be it further
3535 RESOLVED, That the Texas secretary of state forward official
3636 copies of this resolution to the president of the United States, to
3737 the speaker of the House of Representatives of the United States, to
3838 the vice president of the United States in the vice president's
3939 capacity as the presiding officer of the Senate of the United States
4040 at the office located in the United States Capitol Building, and to
4141 all members of the Texas delegation to Congress with the request
4242 that this resolution be officially entered in the Congressional
4343 Record.
