7	7	A JOINT RESOLUTION
8	8	proposing a constitutional amendment providing for the
9	9	establishment of the Alzheimer's Prevention and Research Institute
10	10	of Texas, establishing the Alzheimer's Prevention and Research Fund
11	11	to provide money for research on and prevention and treatment of
12	12	Alzheimer's disease and related disorders in this state, and
13	13	transferring state general revenue to that fund.
14	14	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	15	SECTION 1. Article III, Texas Constitution, is amended by
16	16	adding Section 68 to read as follows:
17	17	Sec. 68. (a) The legislature shall establish the
18	18	Alzheimer's Prevention and Research Institute of Texas to:
19	19	(1) award grants to institutions of learning, advanced
20	20	medical research facilities, public or private persons, and
21	21	collaboratives in this state to provide money for:
22	22	(A) research into the causes of, means of
23	23	prevention of, and treatment and rehabilitation for Alzheimer's
24	24	disease and related disorders;
25	25	(B) research, including translational research,
26	26	to develop therapies, protocols, medical pharmaceuticals, or
27	27	procedures for the substantial mitigation of the symptoms of
28	28	Alzheimer's disease and related disorders;
29	29	(C) facilities, equipment, supplies, salaries,
30	30	benefits, and other costs related to research on Alzheimer's
31	31	disease and related disorders; and
32	32	(D) prevention programs and strategies to
33	33	mitigate the detrimental health impacts of Alzheimer's disease and
34	34	related disorders;
35	35	(2) support institutions of learning and advanced
36	36	medical research facilities and collaboratives in this state in all
37	37	stages of:
38	38	(A) discovering the causes of Alzheimer's
39	39	disease and related disorders;
40	40	(B) developing therapies, protocols, medical
41	41	pharmaceuticals, or procedures for the substantial mitigation of
42	42	the symptoms of Alzheimer's disease and related disorders from
43	43	laboratory research to clinical trials; and
44	44	(C) developing programs to address access to
45	45	advanced treatment for Alzheimer's disease and related disorders;
46	46	and
47	47	(3) establish the appropriate standards and oversight
48	48	bodies to ensure the proper use of funding authorized under this
49	49	section, including facilities development.
50	50	(b) The members of the governing body and any other
51	51	decision-making body of the Alzheimer's Prevention and Research
52	52	Institute of Texas may serve six-year terms.
53	53	(c) The Alzheimer's Prevention and Research Fund is
54	54	established as a special fund in the state treasury outside the
55	55	general revenue fund to be administered by the Alzheimer's
56	56	Prevention and Research Institute of Texas.
57	57	(c-1) On January 1, 2026, the comptroller shall transfer $3
58	58	billion from this state's general revenue fund to the Alzheimer's
59	59	Prevention and Research Fund. The transfer made under this
60	60	subsection is not an appropriation of state tax revenues for the
61	61	purposes of Section 22, Article VIII, of this constitution. This
62	62	subsection expires January 1, 2029.
63	63	(d) The Alzheimer's Prevention and Research Fund consists
64	64	of:
65	65	(1) money transferred to the fund under this section;
66	66	(2) money the legislature appropriates, credits, or
67	67	transfers to the fund;
68	68	(3) gifts and grants, including grants from the
69	69	federal government, and other donations received for the fund;
70	70	(4) patent, royalty, and license fees and other income
71	71	received under a contract executed by the Alzheimer's Prevention
72	72	and Research Institute of Texas; and
73	73	(5) investment earnings and interest earned on amounts
74	74	credited to the fund.
75	75	(e) Notwithstanding any other provision of this
76	76	constitution, the Alzheimer's Prevention and Research Institute of
77	77	Texas, as established by general law, may use money in the
78	78	Alzheimer's Prevention and Research Fund only for the purpose of
79	79	funding:
80	80	(1) grants for research on Alzheimer's disease and
81	81	related disorders, research facilities, and research opportunities
82	82	in this state:
83	83	(A) for the prevention, treatment, and
84	84	rehabilitation of Alzheimer's disease and related disorders and the
85	85	mitigation of the incidence of and detrimental health impacts from
86	86	the disease and disorders; and
87	87	(B) to develop therapies, protocols, medical
88	88	pharmaceuticals, or procedures for the substantial mitigation of
89	89	the symptoms of Alzheimer's disease and related disorders;
90	90	(2) the purchase, construction, or renovation,
91	91	subject to the institute's approval, of facilities by or on behalf
92	92	of a state agency or grant recipient; and
93	93	(3) the institute's operation.
94	94	(f) Before the Alzheimer's Prevention and Research
95	95	Institute of Texas may award a grant authorized under this section,
96	96	the grant recipient must have available an unexpended amount of
97	97	money equal to one-half of the grant amount dedicated to the
98	98	research specified in the grant proposal.
99	99	(g) The reasonable expenses of managing the assets of the
100	100	Alzheimer's Prevention and Research Fund shall be paid from the
101	101	fund.
102	102	SECTION 2. This proposed constitutional amendment shall be
103	103	submitted to the voters at an election to be held November 4, 2025.
104	104	The ballot shall be printed to permit voting for or against the
105	105	proposition: "The constitutional amendment providing for the
106	106	establishment of the Alzheimer's Prevention and Research Institute
107	107	of Texas, establishing the Alzheimer's Prevention and Research Fund
108	108	to provide money for research on and prevention and treatment of
109	109	Alzheimer's disease and related disorders in this state, and
110	110	transferring state general revenue to that fund."
