77 A JOINT RESOLUTION
88 proposing a constitutional amendment providing for the
99 establishment of the Alzheimer's Prevention and Research Institute
1010 of Texas, establishing the Alzheimer's Prevention and Research Fund
1111 to provide money for research on and prevention and treatment of
1212 Alzheimer's disease and related disorders in this state, and
1313 transferring state general revenue to that fund.
1414 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Article III, Texas Constitution, is amended by
1616 adding Section 68 to read as follows:
1717 Sec. 68. (a) The legislature shall establish the
1818 Alzheimer's Prevention and Research Institute of Texas to:
1919 (1) award grants to institutions of learning, advanced
2020 medical research facilities, public or private persons, and
2121 collaboratives in this state to provide money for:
2222 (A) research into the causes of, means of
2323 prevention of, and treatment and rehabilitation for Alzheimer's
2424 disease and related disorders;
2525 (B) research, including translational research,
2626 to develop therapies, protocols, medical pharmaceuticals, or
2727 procedures for the substantial mitigation of the symptoms of
2828 Alzheimer's disease and related disorders;
2929 (C) facilities, equipment, supplies, salaries,
3030 benefits, and other costs related to research on Alzheimer's
3131 disease and related disorders; and
3232 (D) prevention programs and strategies to
3333 mitigate the detrimental health impacts of Alzheimer's disease and
3434 related disorders;
3535 (2) support institutions of learning and advanced
3636 medical research facilities and collaboratives in this state in all
3737 stages of:
3838 (A) discovering the causes of Alzheimer's
3939 disease and related disorders;
4040 (B) developing therapies, protocols, medical
4141 pharmaceuticals, or procedures for the substantial mitigation of
4242 the symptoms of Alzheimer's disease and related disorders from
4343 laboratory research to clinical trials; and
4444 (C) developing programs to address access to
4545 advanced treatment for Alzheimer's disease and related disorders;
4646 and
4747 (3) establish the appropriate standards and oversight
4848 bodies to ensure the proper use of funding authorized under this
4949 section, including facilities development.
5050 (b) The members of the governing body and any other
5151 decision-making body of the Alzheimer's Prevention and Research
5252 Institute of Texas may serve six-year terms.
5353 (c) The Alzheimer's Prevention and Research Fund is
5454 established as a special fund in the state treasury outside the
5555 general revenue fund to be administered by the Alzheimer's
5656 Prevention and Research Institute of Texas.
5757 (c-1) On January 1, 2026, the comptroller shall transfer $3
5858 billion from this state's general revenue fund to the Alzheimer's
5959 Prevention and Research Fund. The transfer made under this
6060 subsection is not an appropriation of state tax revenues for the
6161 purposes of Section 22, Article VIII, of this constitution. This
6262 subsection expires January 1, 2029.
6363 (d) The Alzheimer's Prevention and Research Fund consists
6464 of:
6565 (1) money transferred to the fund under this section;
6666 (2) money the legislature appropriates, credits, or
6767 transfers to the fund;
6868 (3) gifts and grants, including grants from the
6969 federal government, and other donations received for the fund;
7070 (4) patent, royalty, and license fees and other income
7171 received under a contract executed by the Alzheimer's Prevention
7272 and Research Institute of Texas; and
7373 (5) investment earnings and interest earned on amounts
7474 credited to the fund.
7575 (e) Notwithstanding any other provision of this
7676 constitution, the Alzheimer's Prevention and Research Institute of
7777 Texas, as established by general law, may use money in the
7878 Alzheimer's Prevention and Research Fund only for the purpose of
7979 funding:
8080 (1) grants for research on Alzheimer's disease and
8181 related disorders, research facilities, and research opportunities
8282 in this state:
8383 (A) for the prevention, treatment, and
8484 rehabilitation of Alzheimer's disease and related disorders and the
8585 mitigation of the incidence of and detrimental health impacts from
8686 the disease and disorders; and
8787 (B) to develop therapies, protocols, medical
8888 pharmaceuticals, or procedures for the substantial mitigation of
8989 the symptoms of Alzheimer's disease and related disorders;
9090 (2) the purchase, construction, or renovation,
9191 subject to the institute's approval, of facilities by or on behalf
9292 of a state agency or grant recipient; and
9393 (3) the institute's operation.
9494 (f) Before the Alzheimer's Prevention and Research
9595 Institute of Texas may award a grant authorized under this section,
9696 the grant recipient must have available an unexpended amount of
9797 money equal to one-half of the grant amount dedicated to the
9898 research specified in the grant proposal.
9999 (g) The reasonable expenses of managing the assets of the
100100 Alzheimer's Prevention and Research Fund shall be paid from the
101101 fund.
102102 SECTION 2. This proposed constitutional amendment shall be
103103 submitted to the voters at an election to be held November 4, 2025.
104104 The ballot shall be printed to permit voting for or against the
105105 proposition: "The constitutional amendment providing for the
106106 establishment of the Alzheimer's Prevention and Research Institute
107107 of Texas, establishing the Alzheimer's Prevention and Research Fund
108108 to provide money for research on and prevention and treatment of
109109 Alzheimer's disease and related disorders in this state, and
110110 transferring state general revenue to that fund."
