77 A JOINT RESOLUTION
88 proposing a constitutional amendment authorizing the Kickapoo
99 Traditional Tribe of Texas to conduct gaming on certain lands under
1010 state law; limiting certain taxes and fees.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 47(a), Article III, Texas Constitution,
1313 is amended to read as follows:
1414 (a) The Legislature shall pass laws prohibiting lotteries
1515 and gift enterprises in this State other than those authorized by
1616 Subsections (b), (d), (d-1), and (e) of this section and Section 47a
1717 of this article.
1818 SECTION 2. Article III, Texas Constitution, is amended by
1919 adding Section 47a to read as follows:
2020 Sec. 47a. (a) If, after January 1, 2025, this state by
2121 general law or constitutional amendment authorizes video lottery
2222 terminals, slot machines, or other forms of gaming not otherwise
2323 authorized before that date within 200 miles of the boundary of the
2424 reservation of the Kickapoo Traditional Tribe of Texas near Eagle
2525 Pass, Texas, the tribe is authorized to offer at a location the
2626 tribe designates any game, device, or other form of gaming,
2727 including any form of mobile gaming, authorized under that law or
2828 amendment. The number of games or devices authorized at the
2929 designated location is equal to any maximum number of games or
3030 devices authorized under that law or amendment for other gaming
3131 locations. The designated location must be on land in this state
3232 owned or leased by the Kickapoo Traditional Tribe of Texas that is
3333 outside the boundary of the tribe's reservation.
3434 (b) The gaming authorized under this section shall be
3535 regulated by the Kickapoo Traditional Tribe of Texas and the
3636 Secretary of State. A rule on gaming conducted by the tribe that
3737 this state adopts may not be more restrictive than a rule applicable
3838 to other comparable types of gaming licensed by this state.
3939 (c) A state or local tax rate or fee may not be imposed on
4040 the tribe's gaming operations in an amount that exceeds the amount
4141 of a tax rate or fee imposed on the operators of other gaming
4242 locations or facilities in this state.
4343 SECTION 3. This proposed constitutional amendment shall be
4444 submitted to the voters at an election to be held November 4, 2025.
4545 The ballot shall be printed to permit voting for or against the
4646 proposition: "The constitutional amendment authorizing the
4747 Kickapoo Traditional Tribe of Texas to conduct gaming on certain
4848 lands under state law."
