| 10 | 10 | | state law; limiting certain taxes and fees. |

| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 47(a), Article III, Texas Constitution, |
|---|
| 13 | 13 | | is amended to read as follows: |
|---|
| 14 | 14 | | (a) The Legislature shall pass laws prohibiting lotteries |
|---|
| 15 | 15 | | and gift enterprises in this State other than those authorized by |
|---|
| 16 | 16 | | Subsections (b), (d), (d-1), and (e) of this section and Section 47a |
|---|
| 17 | 17 | | of this article. |
|---|
| 18 | 18 | | SECTION 2. Article III, Texas Constitution, is amended by |
|---|
| 19 | 19 | | adding Section 47a to read as follows: |
|---|
| 20 | 20 | | Sec. 47a. (a) If, after January 1, 2025, this state by |
|---|
| 21 | 21 | | general law or constitutional amendment authorizes video lottery |
|---|
| 22 | 22 | | terminals, slot machines, or other forms of gaming not otherwise |
|---|
| 23 | 23 | | authorized before that date within 200 miles of the boundary of the |
|---|
| 24 | 24 | | reservation of the Kickapoo Traditional Tribe of Texas near Eagle |
|---|
| 25 | 25 | | Pass, Texas, the tribe is authorized to offer at a location the |
|---|
| 26 | 26 | | tribe designates any game, device, or other form of gaming, |
|---|
| 27 | 27 | | including any form of mobile gaming, authorized under that law or |
|---|
| 28 | 28 | | amendment. The number of games or devices authorized at the |
|---|
| 29 | 29 | | designated location is equal to any maximum number of games or |
|---|
| 30 | 30 | | devices authorized under that law or amendment for other gaming |
|---|
| 31 | 31 | | locations. The designated location must be on land in this state |
|---|
| 32 | 32 | | owned or leased by the Kickapoo Traditional Tribe of Texas that is |
|---|
| 33 | 33 | | outside the boundary of the tribe's reservation. |
|---|
| 34 | 34 | | (b) The gaming authorized under this section shall be |
|---|
| 35 | 35 | | regulated by the Kickapoo Traditional Tribe of Texas and the |
|---|
| 36 | 36 | | Secretary of State. A rule on gaming conducted by the tribe that |
|---|
| 37 | 37 | | this state adopts may not be more restrictive than a rule applicable |
|---|
| 38 | 38 | | to other comparable types of gaming licensed by this state. |
|---|
| 39 | 39 | | (c) A state or local tax rate or fee may not be imposed on |
|---|
| 40 | 40 | | the tribe's gaming operations in an amount that exceeds the amount |
|---|
| 41 | 41 | | of a tax rate or fee imposed on the operators of other gaming |
|---|
| 42 | 42 | | locations or facilities in this state. |
|---|
| 43 | 43 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 44 | 44 | | submitted to the voters at an election to be held November 4, 2025. |
|---|
| 45 | 45 | | The ballot shall be printed to permit voting for or against the |
|---|
| 46 | 46 | | proposition: "The constitutional amendment authorizing the |
|---|
| 47 | 47 | | Kickapoo Traditional Tribe of Texas to conduct gaming on certain |
|---|
| 48 | 48 | | lands under state law." |
