77 A JOINT RESOLUTION
88 proposing a constitutional amendment authorizing the legislature
99 to designate subjects for legislation during a special session.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 40, Article III, Texas Constitution, is
1212 amended to read as follows:
1313 Sec. 40. (a) When the legislature is [Legislature shall be]
1414 convened in a special session, the legislature may not consider
1515 [there shall be no] legislation on a subject [upon subjects] other
1616 than a subject [those] designated in the proclamation of the
1717 governor [Governor] calling the [such] session, [or] presented to
1818 the legislature [them] by the governor, or designated by either
1919 house of the legislature by resolution approved by a two-thirds
2020 vote of the members of that house. A subject designated by one
2121 house of the legislature may be considered by the other house.
2222 (b) No special [Governor; and no such] session shall be of
2323 longer duration than thirty days.
2424 SECTION 2. This proposed constitutional amendment shall be
2525 submitted to the voters at an election to be held November 4, 2025.
2626 The ballot shall be printed to permit voting for or against the
2727 proposition: "The constitutional amendment authorizing the
2828 legislature to designate subjects for legislation during a special
2929 session."
