10 | 10 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 40, Article III, Texas Constitution, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | Sec. 40. (a) When the legislature is [Legislature shall be] | |
14 | 14 | convened in a special session, the legislature may not consider | |
15 | 15 | [there shall be no] legislation on a subject [upon subjects] other | |
16 | 16 | than a subject [those] designated in the proclamation of the | |
17 | 17 | governor [Governor] calling the [such] session, [or] presented to | |
18 | 18 | the legislature [them] by the governor, or designated by either | |
19 | 19 | house of the legislature by resolution approved by a two-thirds | |
20 | 20 | vote of the members of that house. A subject designated by one | |
21 | 21 | house of the legislature may be considered by the other house. | |
22 | 22 | (b) No special [Governor; and no such] session shall be of | |
23 | 23 | longer duration than thirty days. | |
24 | 24 | SECTION 2. This proposed constitutional amendment shall be | |
25 | 25 | submitted to the voters at an election to be held November 4, 2025. | |
26 | 26 | The ballot shall be printed to permit voting for or against the | |
27 | 27 | proposition: "The constitutional amendment authorizing the | |
28 | 28 | legislature to designate subjects for legislation during a special | |
29 | 29 | session." |
