77 A JOINT RESOLUTION
88 applying to the Congress of the United States to call a convention
99 under Article V of the United States Constitution for the limited
1010 purpose of proposing one or more amendments to the constitution to
1111 impose fiscal restraints on the federal government, to limit the
1212 power and jurisdiction of the federal government, and to limit the
1313 terms of office of federal officials and members of Congress.
1414 WHEREAS, The drafters of the United States Constitution
1515 empowered state legislatures to be guardians of liberty against
1616 abuses of power by the federal government; and
1717 WHEREAS, The federal government has abused its power by
1818 creating a crushing national debt through improper and imprudent
1919 spending; and
2020 WHEREAS, The federal government has abused its power by
2121 invading the legitimate role of the states through the manipulative
2222 process of federal mandates that are to a great extent unfunded; and
2323 WHEREAS, The federal government has ceased to abide by a
2424 proper interpretation of the United States Constitution; and
2525 WHEREAS, It is the solemn duty of state legislatures to
2626 protect the liberty of the people and of future generations by
2727 proposing amendments to the United States Constitution that place
2828 clear restraints on federal power; and
2929 WHEREAS, Article V of the United States Constitution
3030 authorizes the several state legislatures to restrict the power of
3131 the federal government through the amendment process; and
3232 WHEREAS, Article V of the United States Constitution provides
3333 that on application of the legislatures of two-thirds of the
3434 several states Congress shall call a convention for the purpose of
3535 proposing amendments to the constitution; now, therefore, be it
3636 RESOLVED, That the 89th Texas Legislature apply to Congress
3737 to call a convention under Article V of the United States
3838 Constitution for the limited purpose of proposing one or more
3939 amendments to the constitution to impose fiscal restraints on the
4040 federal government, to limit the power and jurisdiction of the
4141 federal government, and to limit the terms of office of federal
4242 officials and members of Congress; and, be it further
4343 RESOLVED, That, unless rescinded by a succeeding
4444 legislature, this application by the 89th Texas Legislature
4545 constitutes a continuing application in accordance with Article V
4646 of the United States Constitution until at least two-thirds of the
4747 legislatures of the several states have applied to Congress to call
4848 a convention for the limited purpose of proposing one or more
4949 amendments to the constitution to impose fiscal restraints on the
5050 federal government, to limit the power and jurisdiction of the
5151 federal government, and to limit the terms of office of federal
5252 officials and members of Congress; and, be it further
5353 RESOLVED, That the Texas secretary of state forward official
5454 copies of this resolution to the president of the United States, to
5555 the speaker of the House of Representatives and the president of the
5656 Senate of the Congress of the United States, and to all members of
5757 the Texas delegation to Congress with the request that this
5858 resolution be officially entered in the Congressional Record as an
5959 application to Congress for a convention under Article V of the
6060 United States Constitution for the limited purpose of proposing one
6161 or more amendments to the constitution to impose fiscal restraints
6262 on the federal government, to limit the power and jurisdiction of
6363 the federal government, and to limit the terms of office of federal
6464 officials and members of Congress; and, be it further
6565 RESOLVED, That the Texas secretary of state forward official
6666 copies of this resolution to the secretaries of state and to the
6767 presiding officers of the legislatures of the several states with
6868 the request that they join this state in applying to Congress for a
6969 convention under Article V of the United States Constitution for
7070 the limited purpose of proposing one or more amendments to the
7171 constitution to impose fiscal restraints on the federal government,
7272 to limit the power and jurisdiction of the federal government, and
7373 to limit the terms of office of federal officials and members of
7474 Congress.
