7	7	A JOINT RESOLUTION
8	8	applying to the Congress of the United States to call a convention
9	9	under Article V of the United States Constitution for the limited
10	10	purpose of proposing one or more amendments to the constitution to
11	11	impose fiscal restraints on the federal government, to limit the
12	12	power and jurisdiction of the federal government, and to limit the
13	13	terms of office of federal officials and members of Congress.
14	14	WHEREAS, The drafters of the United States Constitution
15	15	empowered state legislatures to be guardians of liberty against
16	16	abuses of power by the federal government; and
17	17	WHEREAS, The federal government has abused its power by
18	18	creating a crushing national debt through improper and imprudent
19	19	spending; and
20	20	WHEREAS, The federal government has abused its power by
21	21	invading the legitimate role of the states through the manipulative
22	22	process of federal mandates that are to a great extent unfunded; and
23	23	WHEREAS, The federal government has ceased to abide by a
24	24	proper interpretation of the United States Constitution; and
25	25	WHEREAS, It is the solemn duty of state legislatures to
26	26	protect the liberty of the people and of future generations by
27	27	proposing amendments to the United States Constitution that place
28	28	clear restraints on federal power; and
29	29	WHEREAS, Article V of the United States Constitution
30	30	authorizes the several state legislatures to restrict the power of
31	31	the federal government through the amendment process; and
32	32	WHEREAS, Article V of the United States Constitution provides
33	33	that on application of the legislatures of two-thirds of the
34	34	several states Congress shall call a convention for the purpose of
35	35	proposing amendments to the constitution; now, therefore, be it
36	36	RESOLVED, That the 89th Texas Legislature apply to Congress
37	37	to call a convention under Article V of the United States
38	38	Constitution for the limited purpose of proposing one or more
39	39	amendments to the constitution to impose fiscal restraints on the
40	40	federal government, to limit the power and jurisdiction of the
41	41	federal government, and to limit the terms of office of federal
42	42	officials and members of Congress; and, be it further
43	43	RESOLVED, That, unless rescinded by a succeeding
44	44	legislature, this application by the 89th Texas Legislature
45	45	constitutes a continuing application in accordance with Article V
46	46	of the United States Constitution until at least two-thirds of the
47	47	legislatures of the several states have applied to Congress to call
48	48	a convention for the limited purpose of proposing one or more
49	49	amendments to the constitution to impose fiscal restraints on the
50	50	federal government, to limit the power and jurisdiction of the
51	51	federal government, and to limit the terms of office of federal
52	52	officials and members of Congress; and, be it further
53	53	RESOLVED, That the Texas secretary of state forward official
54	54	copies of this resolution to the president of the United States, to
55	55	the speaker of the House of Representatives and the president of the
56	56	Senate of the Congress of the United States, and to all members of
57	57	the Texas delegation to Congress with the request that this
58	58	resolution be officially entered in the Congressional Record as an
59	59	application to Congress for a convention under Article V of the
60	60	United States Constitution for the limited purpose of proposing one
61	61	or more amendments to the constitution to impose fiscal restraints
62	62	on the federal government, to limit the power and jurisdiction of
63	63	the federal government, and to limit the terms of office of federal
64	64	officials and members of Congress; and, be it further
65	65	RESOLVED, That the Texas secretary of state forward official
66	66	copies of this resolution to the secretaries of state and to the
67	67	presiding officers of the legislatures of the several states with
68	68	the request that they join this state in applying to Congress for a
69	69	convention under Article V of the United States Constitution for
70	70	the limited purpose of proposing one or more amendments to the
71	71	constitution to impose fiscal restraints on the federal government,
72	72	to limit the power and jurisdiction of the federal government, and
73	73	to limit the terms of office of federal officials and members of
74	74	Congress.
