| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article I, Texas Constitution, is amended by |
|---|
| 12 | 12 | | adding Section 36 to read as follows: |
|---|
| 13 | 13 | | Sec. 36. The right of the people to own, hold, and use a |
|---|
| 14 | 14 | | mutually agreed upon medium of exchange, including cash, coin, |
|---|
| 15 | 15 | | bullion, digital currency, or privately issued scrip, when trading |
|---|
| 16 | 16 | | and contracting for goods and services shall not be infringed. No |
|---|
| 17 | 17 | | government shall prohibit or encumber the ownership or holding of |
|---|
| 18 | 18 | | any form or amount of money or other currency. Nothing in this |
|---|
| 19 | 19 | | section shall be construed as restricting this state from choosing |
|---|
| 20 | 20 | | the medium of exchange the state will accept for payments made to |
|---|
| 21 | 21 | | the state. |
|---|
| 22 | 22 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 23 | 23 | | submitted to the voters at an election to be held November 7, 2023. |
|---|
| 24 | 24 | | The ballot shall be printed to permit voting for or against the |
|---|
| 25 | 25 | | proposition: "The constitutional amendment recognizing the right |
|---|
| 26 | 26 | | of the people to own, hold, and use a mutually agreed upon medium of |
|---|
| 27 | 27 | | exchange, including cash, coin, bullion, digital currency, or |
|---|
| 28 | 28 | | privately issued scrip." |
