77 A JOINT RESOLUTION
88 proposing a constitutional amendment authorizing the legislature
99 to legalize wagering in this state on certain sporting events.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 47, Article III, Texas Constitution, is
1212 amended by amending Subsection (a) and adding Subsection (f) to
1313 read as follows:
1414 (a) The Legislature shall pass laws prohibiting lotteries
1515 and gift enterprises in this State other than those authorized by
1616 Subsections (b), (d), (d-1), [and] (e), and (f) of this section.
1717 (f) The legislature by law may authorize and regulate the
1818 placing of wagers on sporting events. A law enacted under this
1919 subsection may authorize the conduct of sports wagering only by:
2020 (1) a sports team, as defined by general law, in
2121 existence on January 1, 2025;
2222 (2) a sports organization that held in this state
2323 before January 1, 2025, sanctioned annual professional golf
2424 tournaments as part of a national tour of professional golfers;
2525 (3) a class 1 racetrack in operation on January 1,
2626 2025; or
2727 (4) a designee of an entity described by Subdivisions
2828 (1)-(3) of this subsection.
2929 SECTION 2. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 4, 2025.
3131 The ballot shall be printed to permit voting for or against the
3232 proposition: "The constitutional amendment authorizing the
3333 legislature to legalize wagering in this state on certain sporting
3434 events."
