7+ A JOINT RESOLUTION
128 proposing a constitutional amendment to clarify and implement
139 certain provisions governing the impeachment, trial, removal from
1410 office, and disqualification of public officers.
1511 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. Section 5, Article XV, Texas Constitution, is
1713 amended to read as follows:
1814 Sec. 5. (a) All officers against whom articles of
1915 impeachment may be preferred shall be suspended from the exercise
2016 of the duties of their offices [office], with ordinary pay, during
2117 the pendency of such impeachment.
2218 (b) The Governor may make a provisional appointment to fill
2319 the vacancy[,] occasioned by the suspension of an officer, other
2420 than the Governor, until the decision on the impeachment.
2521 (c) Section 16, Article IV, of this Constitution applies to
2622 a vacancy occasioned by the suspension of the Governor on
2723 impeachment or by the removal of the Governor from office.
2824 SECTION 2. Section 7, Article XV, Texas Constitution, is
2925 amended to read as follows:
3026 Sec. 7. (a) The Legislature shall provide by law for the
3127 trial and removal from office of all officers of this State, the
3228 modes for which have not been provided in this Constitution.
3329 (b) The Legislature may enact general laws, consistent with
3430 this Constitution, to implement this Article or another provision
3531 of this Constitution providing for the impeachment, trial, removal
3632 from office, or disqualification of an officer of this State.
3733 SECTION 3. This proposed constitutional amendment shall be
3834 submitted to the voters at an election to be held November 4, 2025.
3935 The ballot shall be printed to permit voting for or against the
4036 proposition: "The constitutional amendment clarifying and
4137 implementing certain provisions governing the impeachment, trial,
4238 removal from office, and disqualification of public officers."
