12	8		proposing a constitutional amendment to clarify and implement
13	9		certain provisions governing the impeachment, trial, removal from
14	10		office, and disqualification of public officers.
15	11		BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	12		SECTION 1. Section 5, Article XV, Texas Constitution, is
17	13		amended to read as follows:
18	14		Sec. 5. (a) All officers against whom articles of
19	15		impeachment may be preferred shall be suspended from the exercise
20	16		of the duties of their offices [office], with ordinary pay, during
21	17		the pendency of such impeachment.
22	18		(b) The Governor may make a provisional appointment to fill
23	19		the vacancy[,] occasioned by the suspension of an officer, other
24	20		than the Governor, until the decision on the impeachment.
25	21		(c) Section 16, Article IV, of this Constitution applies to
26	22		a vacancy occasioned by the suspension of the Governor on
27	23		impeachment or by the removal of the Governor from office.
28	24		SECTION 2. Section 7, Article XV, Texas Constitution, is
29	25		amended to read as follows:
30	26		Sec. 7. (a) The Legislature shall provide by law for the
31	27		trial and removal from office of all officers of this State, the
32	28		modes for which have not been provided in this Constitution.
33	29		(b) The Legislature may enact general laws, consistent with
34	30		this Constitution, to implement this Article or another provision
35	31		of this Constitution providing for the impeachment, trial, removal
36	32		from office, or disqualification of an officer of this State.
37	33		SECTION 3. This proposed constitutional amendment shall be
38	34		submitted to the voters at an election to be held November 4, 2025.
39	35		The ballot shall be printed to permit voting for or against the
40	36		proposition: "The constitutional amendment clarifying and
41	37		implementing certain provisions governing the impeachment, trial,
42	38		removal from office, and disqualification of public officers."
