| 10 | 10 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Article VIII, Texas Constitution, is amended by | |
| 12 | 12 | adding Section 26 to read as follows: | |
| 13 | 13 | Sec. 26. The legislature may not impose a tax on: | |
| 14 | 14 | (1) the carbon content of a fuel; or | |
| 15 | 15 | (2) the emission of carbon dioxide or other greenhouse | |
| 16 | 16 | gas that results from the use, production, or consumption of any | |
| 17 | 17 | good or service. | |
| 18 | 18 | SECTION 2. This proposed constitutional amendment shall be | |
| 19 | 19 | submitted to the voters at an election to be held November 4, 2025. | |
| 20 | 20 | The ballot shall be printed to permit voting for or against the | |
| 21 | 21 | proposition: "The constitutional amendment prohibiting the | |
| 22 | 22 | imposition of a carbon tax." |
