77 A JOINT RESOLUTION
88 proposing a constitutional amendment to authorize the legislature
99 to exempt from ad valorem taxation the total appraised value of real
1010 property used as a data center and the tangible personal property
1111 used by the data center to meet the data center's demand for energy.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article VIII, Texas Constitution, is amended by
1414 adding Section 1-z to read as follows:
1515 Sec. 1-z. (a) The legislature by general law may exempt from
1616 ad valorem taxation the total appraised value of:
1717 (1) real property used as a data center; and
1818 (2) tangible personal property located at the data
1919 center that is used to meet the data center's demand for energy.
2020 (b) The legislature by general law may prescribe additional
2121 eligibility requirements for the exemption authorized by this
2222 section.
2323 SECTION 2. This proposed constitutional amendment shall be
2424 submitted to the voters at an election to be held November 4, 2025.
2525 The ballot shall be printed to permit voting for or against the
2626 proposition: "The constitutional amendment to authorize the
2727 legislature to exempt from ad valorem taxation the total appraised
2828 value of real property used as a data center and the tangible
2929 personal property used by the data center to meet the data center's
3030 demand for energy."
