Aviation Noise and Emissions Mitigation Act

Impact

The implementation of HB 1048 is expected to significantly influence state laws regarding environmental protections and public health. By focusing on aviation-related pollution, the bill aims to empower local communities to understand and address the specific air quality issues they face. Through targeted grant programs, it prioritizes support for disadvantaged communities that are most negatively affected by aircraft noise and emissions. This initiative not only seeks to improve air quality but also aims to foster health equity, by providing necessary resources and addressing health disparities linked to environmental exposures.

Summary

House Bill 1048, known as the Aviation Noise and Emissions Mitigation Act, seeks to establish a series of pilot grant programs through the Environmental Protection Agency (EPA). The primary objective of the bill is to conduct comprehensive research and collect data on noise and emissions from aircraft and airports. The resulting data will be utilized to develop a mitigation strategy that addresses the environmental and health impacts experienced by communities situated near airports and flight paths. The bill mandates the EPA to set up these programs within specified timelines, ensuring a systematic approach in assessing noise pollution and greenhouse gas emissions relevant to these communities.

Contention

However, the bill may encounter contention, particularly concerning the prioritization of funding and resources. Critics may argue that the focus on aviation noise and emissions could overshadow other pressing environmental issues. Additionally, stakeholders may express concerns over the design and execution of the grant programs, particularly regarding transparency and community involvement. Ensuring that the voices of affected communities are heard and incorporated into the mitigation strategies will be crucial to the bill's acceptance and success.

Aviation-Impacted Communities ActThis bill increases access to noise mitigation measures for aviation-impacted communities. Under the bill, an aviation-impacted community is a community that is located not more than one mile from any point at which a commercial or cargo jet route is 3,000 feet or less above ground level. The bill expands noise mitigation program funding under the Airport Improvement Program to include aviation-impacted communities that are not currently within the 65 day-night average sound level (DNL) standard. The Federal Aviation Administration (FAA) must conduct outreach to aviation-impacted communities to inform them of the opportunity to be a designated community. A designated community must form a community board to provide information to airport operators and the FAA concerning aviation impacts (e.g., aircraft noise).A community board may petition the FAA to conduct a community assessment and, based on the assessment, the FAA must devise an action plan that alleviates or addresses the community’s concerns. In addition, the FAA must enter into an agreement with the National Academy of Sciences to conduct a study and provide the FAA with a framework and diagnostic tool for conducting community assessments. The FAA must provide grants for necessary noise mitigation in a designated community for residences, hospitals, nursing homes, adult or child day care centers, schools, and places of worship. Further, the FAA and airport operators must provide (1) noise mitigation grants for communities subject to significant frequency of overhead flights, and (2) noise mitigation for residences impacted by significant nighttime aircraft noise.
