18	18	To remove the discretionary inflater from the baseline and
19	19	to provide that the salaries of Members of a House
20	20	of Congress will be held in escrow if that House has
21	21	not agreed to a concurrent resolution on the budget
22	22	for fiscal year 2024.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Budget Process En-4
27	27	hancement Act’’. 5

33	33	SEC. 101. CHANGES IN THE BASELINE. 3
34	34	Section 257(c) of the Balanced Budget and Emer-4
35	35	gency Deficit Control Act of 1985 is amended— 5
36	36	(1) in the second sentence of paragraph (1), by 6
37	37	striking everything that follows ‘‘current year,’’ and 7
38	38	inserting ‘‘excluding resources designated as an 8
39	39	emergency requirement and any resources provided 9
40	40	in supplemental appropriation laws.’’; 10
41	41	(2) by striking paragraphs (2), (3), (4), and 11
42	42	(5); 12
43	43	(3) by redesignating paragraph (6) as para-13
44	44	graph (2); and 14
45	45	(4) by inserting after paragraph (2) the fol-15
46	46	lowing new paragraph: 16
47	47	‘‘(3) N
48	48	O ADJUSTMENT FOR INFLATION .—No 17
49	49	adjustment shall be made for inflation or for any 18

61	61	OLDINGSALARIES INESCROW.— 7
62	62	(1) I
63	63	N GENERAL.—If by April 15, 2023, a 8
64	64	House of Congress has not agreed to a concurrent 9
65	65	resolution on the budget for fiscal year 2024 pursu-10
66	66	ant to section 301 of the Congressional Budget Act 11
67	67	of 1974, during the period described in paragraph 12
68	68	(2) the payroll administrator of that House of Con-13
69	69	gress shall deposit in an escrow account all pay-14
70	70	ments otherwise required to be made during such 15
71	71	period for the compensation of Members of Congress 16
72	72	who serve in that House of Congress, and shall re-17
73	73	lease such payments to such Members only upon the 18
74	74	expiration of such period. 19
75	75	(2) P
76	76	ERIOD DESCRIBED.—With respect to a 20
77	77	House of Congress, the period described in this 21
78	78	paragraph is the period which begins on April 16, 22
79	79	2023, and ends on the earlier of— 23
80	80	(A) the day on which the House of Con-24
81	81	gress agrees to a concurrent resolution on the 25

86	86	301 of the Congressional Budget Act of 1974; 2

91	91	ITHHOLDING AND REMITTANCE OF 6
92	92	AMOUNTS FROM PAYMENTS HELD IN ESCROW .—The 7
93	93	payroll administrator shall provide for the same 8
94	94	withholding and remittance with respect to a pay-9
95	95	ment deposited in an escrow account under para-10
96	96	graph (1) that would apply to the payment if the 11
97	97	payment were not subject to paragraph (1). 12

99	99	ELEASE OF AMOUNTS AT END OF THE 13
100	100	CONGRESS.—In order to ensure that this section is 14
101	101	carried out in a manner that shall not vary the com-15
102	102	pensation of Senators or Representatives in violation 16
103	103	of the twenty-seventh article of amendment to the 17
104	104	Constitution of the United States, the payroll ad-18
105	105	ministrator of a House of Congress shall release for 19
106	106	payments to Members of that House of Congress 20
107	107	any amounts remaining in any escrow account under 21
108	108	this section on the last day of the One Hundred 22
109	109	Eighteenth Congress. 23

111	111	OLE OF SECRETARY OF THE TREASURY .— 24
112	112	The Secretary of the Treasury shall provide the pay-25

117	117	such assistance as may be necessary to enable the 2
118	118	payroll administrators to carry out this section. 3

120	120	REATMENT OF DELEGATES ASMEMBERS.—In 4
121	121	this section, the term ‘‘Member of Congress’’ includes a 5
122	122	Delegate or Resident Commissioner to the Congress. 6

124	124	AYROLLADMINISTRATOR DEFINED.—In this 7
125	125	section, the term ‘‘payroll administrator’’ of a House of 8
126	126	Congress means— 9
127	127	(1) in the case of the House of Representatives, 10
128	128	the Chief Administrative Officer of the House of 11
129	129	Representatives, or an employee of the Office of the 12
130	130	Chief Administrative Officer who is designated by 13
131	131	the Chief Administrative Officer to carry out this 14
132	132	section; and 15
133	133	(2) in the case of the Senate, the Secretary of 16
134	134	the Senate, or an employee of the Office of the Sec-17
135	135	retary of the Senate who is designated by the Sec-18
136	136	retary to carry out this section. 19
137	137	SEC. 202. DETERMINATION OF COMPLIANCE WITH STATU-20
138	138	TORY REQUIREMENT TO SUBMIT THE PRESI-21
139	139	DENT’S BUDGET. 22
140	140	Not later than 3 days after the President’s budget 23
141	141	is due, the Inspector General of the Office of Personnel 24
142	142	Management shall— 25

151	151	mination to the Chairs of the Committee on the 6
152	152	Budget and the Committee on Appropriations of the 7
153	153	Senate and the Chairs of the Committee on the 8
154	154	Budget and the Committee on Appropriations of the 9
155	155	House of Representatives. 10
156	156	SEC. 203. NO PAY UPON FAILURE TO TIMELY SUBMIT THE 11
157	157	PRESIDENT’S BUDGET TO CONGRESS. 12
158	158	(a) I
159	159	NGENERAL.—Notwithstanding any other provi-13
160	160	sion of law, no funds may be appropriated or otherwise 14
161	161	be made available from the United States Treasury for 15
162	162	the pay of the Director of OMB, Deputy Director of OMB, 16
163	163	and the Deputy Director for Management of OMB during 17
164	164	any period of noncompliance determined by the Inspector 18
165	165	General of the Office of Personnel Management under sec-19
166	166	tion 202. 20

168	168	ORETROACTIVEPAY.—The Director of OMB, 21
169	169	Deputy Director of OMB, and the Deputy Director for 22
170	170	Management of OMB may not receive pay for any period 23
171	171	of noncompliance determined by the Inspector General of 24
