3623 NGENERAL.—The Administrator of the Envi-5
3724 ronmental Protection Agency shall, as necessary, revise 6
3825 regulations under parts 70 and 71 of title 40, Code of 7
3926 Federal Regulations, to— 8
40-(1) authorize the owner or operator of a critical 9
41-energy resource facility to utilize flexible air permit-10
42-ting (as described in the final rule titled ‘‘Operating 11
43-Permit Programs; Flexible Air Permitting Rule’’ 12
44-published by the Environmental Protection Agency 13
45-in the Federal Register on October 6, 2009 (74 Fed. 14
46-Reg. 51418)) with respect to such critical energy re-15
47-source facility; and 16
48-(2) facilitate flexible, market-responsive oper-17
49-ations (as described in the final rule identified in 18
50-paragraph (1)) with respect to critical energy re-19
51-source facilities. 20
