4141 SEC. 3. PROHIBITION OF RULES MANDATING VACCINA-10

4343 The Secretary of Labor may not issue any rule re-12
4444 quiring employers to mandate vaccination of employees 13
4545 against COVID–19 or requiring testing of employees who 14
4646 are unvaccinated against COVID–19. 15
4747 SEC. 4. PROHIBITION ON MEDICARE AND MEDICAID 16
4848 COVID–19 VACCINATION MANDATES. 17
4949 Notwithstanding any provision of title XI, XVIII, or 18
5050 XIX of the Social Security Act (42 U.S.C. 1301 et seq., 19
5151 1395 et seq., 1396 et seq.), the Secretary of Health and 20
5252 Human Services may not require a health care provider, 21
5353 as a condition of participation in the Medicare or Medicaid 22
5454 program, to mandate vaccination of employees against 23
5555 COVID–19 or require testing of employees who are 24
5656 unvaccinated against COVID–19, and may not otherwise 25
