14	14	Parenthood Federation of America, Inc.
15	15	Be it enacted by the Senate and House of Representa-1
16	16	tives of the United States of America in Congress assembled, 2
17	17	SECTION 1. SHORT TITLE. 3
18	18	This Act may be cited as the ‘‘Defund Planned Par-4
19	19	enthood Act of 2023’’. 5
20	20	SEC. 2. FINDINGS. 6
21	21	Congress finds the following: 7
22	22	(1) State and county health departments, com-8
23	23	munity health centers, hospitals, physicians offices, 9
24	24	and other entities currently provide, and will con-10

28	28	tinue to provide, health services to women. Such 1
29	29	health services include relevant diagnostic laboratory 2
30	30	and radiology services, well-child care, prenatal and 3
31	31	postpartum care, immunization, family planning 4
32	32	services (including contraception), cervical and 5
33	33	breast cancer screenings and referrals, and sexually 6
34	34	transmitted disease testing. 7
35	35	(2) Many such entities provide services to all 8
36	36	persons, regardless of the person’s ability to pay, 9
37	37	and provide services in medically underserved areas 10
38	38	and to medically underserved populations. 11
39	39	(3) All funds that are no longer available to 12
40	40	Planned Parenthood Federation of America, Inc. 13
41	41	and its affiliates and clinics pursuant to this Act will 14
42	42	continue to be made available to other eligible enti-15
43	43	ties to provide women’s health care services. 16
44	44	(4) Funds authorized to be appropriated, and 17
45	45	appropriated, by section 4 are offset by the funding 18
46	46	limitation under section 3(a). 19
47	47	SEC. 3. MORATORIUM ON FEDERAL FUNDING TO PLANNED 20
48	48	PARENTHOOD FEDERATION OF AMERICA, 21
49	49	INC. 22
50	50	(a) I
51	51	NGENERAL.—For the one-year period beginning 23
52	52	on the date of the enactment of this Act, subject to sub-24
53	53	section (b), no funds authorized or appropriated by Fed-25

57	57	eral law may be made available for any purpose to Planned 1
58	58	Parenthood Federation of America, Inc., or any affiliate 2
59	59	or clinic of Planned Parenthood Federation of America, 3
60	60	Inc., unless such entities certify that Planned Parenthood 4
61	61	Federation of America affiliates and clinics will not per-5
62	62	form, and will not provide any funds to any other entity 6
63	63	that performs, an abortion during such period. 7
64	64	(b) E
65	65	XCEPTION.—Subsection (a) shall not apply to 8
66	66	an abortion— 9
67	67	(1) if the pregnancy is the result of an act of 10
68	68	rape or incest; or 11
69	69	(2) in the case where a woman suffers from a 12
70	70	physical disorder, physical injury, or physical illness 13
71	71	that would, as certified by a physician, place the 14
72	72	woman in danger of death unless an abortion is per-15
73	73	formed, including a life-endangering physical condi-16
74	74	tion caused by or arising from the pregnancy itself. 17

76	76	EPAYMENT.—The Secretary of Health and 18
77	77	Human Services and the Secretary of Agriculture shall 19
78	78	seek repayment of any Federal assistance received by 20
79	79	Planned Parenthood Federation of America, Inc., or any 21
80	80	affiliate or clinic of Planned Parenthood Federation of 22
81	81	America, Inc., if it violates the terms of the certification 23
82	82	required by subsection (a) during the period specified in 24
83	83	subsection (a). 25

89	89	(a) I
90	90	NGENERAL.—There is authorized to be appro-3
91	91	priated, and appropriated, $235,000,000 for the commu-4
92	92	nity health center program under section 330 of the Public 5
93	93	Health Service Act (42 U.S.C. 254b), in addition to any 6
94	94	other funds made available to such program, for the period 7
95	95	for which the funding limitation under section 3(a) ap-8
96	96	plies. 9
97	97	(b) L
98	98	IMITATION.—None of the funds authorized or 10
99	99	appropriated pursuant to subsection (a) may be expended 11
100	100	for an abortion other than as described in section 3(b). 12
101	101	SEC. 5. RULE OF CONSTRUCTION. 13
102	102	Nothing in this Act shall be construed to reduce over-14
103	103	all Federal funding available in support of women’s health. 15
