17	17	tives if a Speaker is not elected on the first day of
18	18	a Congress.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘No Pay for Disarray 4
23	23	Act’’. 5
24	24	SEC. 2. REDUCTION OF PAY OF MEMBERS OF HOUSE IF 6
25	25	SPEAKER IS NOT ELECTED. 7

27	27	EDUCTION OFPAY.— 8

31	31	(1) REDUCTION.—If, by the end of the first day 1
32	32	of a Congress, the House of Representatives has not 2
33	33	elected a Speaker, the annual rate of pay applicable 3
34	34	under section 601(a) of the Legislative Reorganiza-4
35	35	tion Act of 1946 (2 U.S.C. 4501) with respect to 5
36	36	each Member of the House of Representatives for 6
37	37	the year shall be reduced by an amount equal to the 7
38	38	product of— 8
39	39	(A) an amount equal to one day’s worth of 9
40	40	pay under such annual rate; and 10
41	41	(B) the number of 24-hour periods occur-11
42	42	ring during the Congress during which no 12
43	43	Speaker has been elected for the Congress. 13

45	45	FFECTIVE DATE.—This subsection shall 14
46	46	apply with respect to the One Hundred Nineteenth 15
47	47	Congress and each succeeding Congress. 16

52	52	OLDING SALARIES IN ESCROW .—If, by the 19
53	53	end of the first day of the One Hundred Eighteenth 20
54	54	Congress, the House of Representatives has not 21
55	55	elected a Speaker, the Chief Administrative Officer 22
56	56	of the House of Representatives, or an employee of 23
57	57	the Office of the Chief Administrative Officer who is 24

61	61	designated by the Chief Administrative Officer to 1
62	62	carry out this Act, shall— 2
63	63	(A) deposit in an escrow account and ex-3
64	64	clude from the payments otherwise required to 4
65	65	be made for the compensation of each Member 5
66	66	of the House of Representatives with respect to 6
67	67	a pay period during which the House has not 7
68	68	elected a Speaker an amount equal to the prod-8
69	69	uct of— 9
70	70	(i) the daily rate of pay of the Mem-10
71	71	ber under section 601(a) of the Legislative 11
72	72	Reorganization Act of 1946 (2 U.S.C. 12
73	73	4501); and 13
74	74	(ii) the number of 24-hour periods 14
75	75	during which no Speaker has been elected 15
76	76	for the One Hundred Eighteenth Congress; 16
77	77	and 17
78	78	(B) release amounts deposited in an es-18
79	79	crow account under subparagraph (A) to such 19
80	80	Member of the House of Representatives only 20
81	81	upon the expiration of the period described in 21
82	82	paragraph (2). 22

84	84	ERIOD DESCRIBED.—The period described 23
85	85	in this paragraph is the period that— 24

89	89	(A) begins on the first day of the One 1
90	90	Hundred Eighteenth Congress; and 2
91	91	(B) ends on the earlier of— 3
92	92	(i) the date on the House elects a 4
93	93	Speaker for the One Hundred Eighteenth 5
94	94	Congress; or 6
95	95	(ii) the last day of the One Hundred 7
96	96	Eighteenth Congress. 8

98	98	ITHHOLDING AND REMITTANCE OF 9
99	99	AMOUNTS FROM PAYMENTS HELD IN ESCROW .—The 10
100	100	Chief Administrative Officer of the House of Rep-11
101	101	resentatives, or an employee of the Office of the 12
102	102	Chief Administrative Officer who is designated by 13
103	103	the Chief Administrative Officer to carry out this 14
104	104	Act, shall provide for the same withholding and re-15
105	105	mittance with respect to a payment deposited in an 16
106	106	escrow account under paragraph (1) that would 17
107	107	apply to the payment if the payment were not sub-18
108	108	ject to paragraph (1). 19

110	110	ELEASE OF AMOUNTS AT END OF THE 20
111	111	CONGRESS.—In order to ensure that this subsection 21
112	112	is carried out in a manner that shall not vary the 22
113	113	compensation of Representatives in violation of the 23
114	114	twenty-seventh amendment to the Constitution of 24
115	115	the United States, the Chief Administrative Officer 25

120	120	the Office of the Chief Administrative Officer who is 2
121	121	designated by the Chief Administrative Officer to 3
122	122	carry out this Act, shall release for payment to 4
123	123	Members of the House of Representatives any 5
124	124	amounts remaining in any escrow account under this 6
125	125	section on the last day of the One Hundred Eight-7
126	126	eenth Congress. 8

128	128	EMBERDEFINED.—In this section, the term 9
129	129	‘‘Member of the House of Representatives’’ means an indi-10
130	130	vidual serving in a position in the House of Representa-11
131	131	tives which is covered under subparagraph (A), (B), or 12
132	132	(C) of section 601(a)(1) of the Legislative Reorganization 13
133	133	Act of 1946 (2 U.S.C. 4501(1)). 14
