85	85	State law, any vote-by-mail system used in an election for 10
86	86	Federal office must be designed and implemented to en-11
87	87	sure a secure, uniform, and timely system to cast a mail- 12
88	88	in ballot in accordance with this section. 13

92	92	N GENERAL.—Requests for a mail-in bal-15
93	93	lot under such system may be submitted electroni-16
94	94	cally or by postal mail using a standardized form ap-17
95	95	proved for such requests by the chief State election 18

98	98	EQUEST.—The form for such requests 20
99	99	must enable an election official who receives the re-21
100	100	quest to confirm— 22
101	101	‘‘(A) the identity of the individual submit-23
102	102	ting the request; 24

111	111	registered to vote (if different than the mailing 6
112	112	address where the ballot is requested to be 7
113	113	sent). 8

115	115	EADLINE FOR SUBMISSION .—Such re-9
116	116	quest must be submitted by an individual and re-10
117	117	ceived by the office of the State or local election su-11
118	118	pervisor not later than 21 days before the date of 12
119	119	the election for Federal office. 13

121	121	AILING OF BALLOTS.—Upon receipt of 14
122	122	such a request, the State or local election supervisor 15
123	123	shall fulfill the request by mailing a mail-in ballot to 16
124	124	the individual within 3 days. 17

126	126	EQUIREMENTS FOR STATE ORLOCALELEC-18
127	127	TIONOFFICIALS.—The office of the State or local election 19
128	128	supervisor shall— 20
129	129	‘‘(1) record the total number of mail-in ballots 21
130	130	sent to voters pursuant to this section; and 22
131	131	‘‘(2) include a notation on the voter rolls main-23
132	132	tained by the office and provided to the individual 24
133	133	polling locations, which identifies that a voter has 25

144	144	Federal office, a mail-in ballot must— 6
145	145	‘‘(A) be marked using blue or black ink, 7
146	146	and properly designate the individual’s vote for 8
147	147	each candidate; 9
148	148	‘‘(B) be signed by the individual using the 10
149	149	same signature the individual used to register 11
150	150	to vote; 12
151	151	‘‘(C) be dated; 13
152	152	‘‘(D) be received by the appropriate elec-14
153	153	tion official no later than the time polls close on 15
154	154	the date of the election; and 16
155	155	‘‘(E) include an attestation, signed by the 17
156	156	individual, that the individual submitting the 18
157	157	mail-in ballot is— 19
158	158	‘‘(i) the individual to whom the ballot 20

160	160	‘‘(ii) registered to vote in the jurisdic-22
161	161	tion where the ballot is being submitted; 23

227	227	paragraph, the term ‘caregiver’ means an indi-21
228	228	vidual who has the responsibility for the care of 22
229	229	an older individual, either voluntarily, by con-23
230	230	tract, by receipt of payment for care, or as a re-24
231	231	sult of the operation of law and means an indi-25

241	241	The prohibition under paragraph (1) shall not apply 6
242	242	to the incidental possession of mail-in ballots by a 7
243	243	postal worker or election official acting within the 8
244	244	scope of his or her official capacity. 9

246	246	ENALTY.—Any person who violates this 10
247	247	subsection shall be fined under title 18, United 11
248	248	States Code, or imprisoned not more than 1 year, or 12

341	341	(A) the right to vote is a fundamental 8
342	342	right of citizens of the United States; 9
343	343	(B) it is the responsibility of the State and 10
344	344	Federal Governments to ensure that every eligi-11
345	345	ble citizen is registered to vote; 12
346	346	(C) existing voter registration systems can 13
347	347	be inaccurate, costly, inaccessible and con-14
348	348	fusing, with damaging effects on voter partici-15
349	349	pation in elections and disproportionate impacts 16
350	350	on young people, persons with disabilities, and 17
351	351	racial and ethnic minorities; and 18
352	352	(D) voter registration systems must be up-19
353	353	dated with 21st-century technologies and proce-20
354	354	dures to maintain their security. 21

356	356	URPOSE.—It is the purpose of this title— 22
357	357	(A) to establish that it is the responsibility 23
358	358	of government at every level to ensure that all 24
359	359	eligible citizens are registered to vote; 25

370	370	(D) to protect and enhance the integrity, 8
371	371	accuracy, efficiency, and accessibility of the 9
372	372	electoral process for all eligible citizens. 10
373	373	SEC. 202. AUTOMATIC REGISTRATION OF ELIGIBLE INDI-11

380	380	cial of each State shall establish and operate a sys-16
381	381	tem of automatic registration for the registration of 17
382	382	eligible individuals to vote for elections for Federal 18
383	383	office in the State, in accordance with the provisions 19

386	386	EFINITION.—The term ‘‘automatic reg-21
387	387	istration’’ means a system that registers an indi-22
388	388	vidual to vote in elections for Federal office in a 23
389	389	State, if eligible, by electronically transferring the 24
390	390	information necessary for registration from govern-25

399	399	EGISTRATION OF VOTERSBASED ONNEW 5

401	401	GENCYRECORDS.—The chief State election official 6
402	402	shall— 7
403	403	(1) not later than 15 days after a contributing 8
404	404	agency has transmitted information with respect to 9
405	405	an individual pursuant to section 203, ensure that 10
406	406	the individual is registered to vote in elections for 11
407	407	Federal office in the State if the individual is eligible 12
408	408	to be registered to vote in such elections; and 13
409	409	(2) send written notice to the individual, in ad-14
410	410	dition to other means of notice established by this 15
411	411	part, of the individual’s voter registration status. 16

413	413	NE-TIMEREGISTRATION OFVOTERSBASED ON 17

415	415	XISTINGCONTRIBUTINGAGENCYRECORDS.—The chief 18
416	416	State election official shall— 19
417	417	(1) identify all individuals whose information is 20
418	418	transmitted by a contributing agency pursuant to 21
419	419	section 204 and who are eligible to be, but are not 22
420	420	currently, registered to vote in that State; 23
421	421	(2) promptly send each such individual written 24
422	422	notice, in addition to other means of notice estab-25

433	433	(B) a statement offering the opportunity to 8
434	434	decline voter registration through means con-9
435	435	sistent with the requirements of this title; 10
436	436	(C) in the case of a State in which affili-11
437	437	ation or enrollment with a political party is re-12
438	438	quired in order to participate in an election to 13
439	439	select the party’s candidate in an election for 14
440	440	Federal office, a statement offering the indi-15
441	441	vidual the opportunity to affiliate or enroll with 16
442	442	a political party or to decline to affiliate or en-17
443	443	roll with a political party, through means con-18
444	444	sistent with the requirements of this title; 19
445	445	(D) the substantive qualifications of an 20
446	446	elector in the State as listed in the mail voter 21
447	447	registration application form for elections for 22
448	448	Federal office prescribed pursuant to section 9 23
449	449	of the National Voter Registration Act of 1993, 24
450	450	the consequences of false registration, and a 25
