45+N GENERAL.—Chapter 36 of title 38, United 9
46+States Code, is amended by adding at the end the fol-10
47+lowing new section: 11
48+‘‘§ 3699C. High technology program 12
2349 ‘‘(a) E
24-STABLISHMENT.—(1) The Secretary shall 11
25-carry out a program under which the Secretary provides 12
26-covered individuals with the opportunity to enroll in high 13
27-technology programs of education that the Secretary de-14
28-termines provide training or skills sought by employers in 15
29-a relevant field or industry. 16
30-‘‘(2) Not more than 6,000 covered individuals may 17
31-participate in the program under this section in any fiscal 18
32-year. 19
50+STABLISHMENT.—(1) The Secretary shall carry 13
51+out a program under which the Secretary provides covered 14
52+individuals with the opportunity to enroll in high tech-15
53+nology programs of education that the Secretary determines 16
54+provide training or skills sought by employers in a relevant 17
55+field or industry. 18
56+‘‘(2) Not more than 6,000 covered individuals may 19
57+participate in the program under this section in any fiscal 20
58+year. 21
3359 ‘‘(b) A
34-MOUNT OFASSISTANCE.—(1) The Secretary 20
35-shall provide, to each covered individual who pursues a 21
36-high technology program of education under this section, 22
37-educational assistance in amounts equal to the amounts 23
38-provided under section 3313(c)(1) of this title, including 24
39-with respect to the housing stipend described in that sec-25
40-tion and in accordance with the treatment of programs 26 3
41-•HR 1669 EH
42-that are distance learning and programs that are less than 1
43-half-time. 2
44-‘‘(2) Under paragraph (1), the Secretary shall pro-3
45-vide such amounts of educational assistance to a covered 4
46-individual for each of the following: 5
47-‘‘(A) A high technology program of education. 6
48-‘‘(B) A second such program if— 7
49-‘‘(i) the second such program begins at 8
50-least 18 months after the covered individual 9
51-graduates from the first such program; and 10
52-‘‘(ii) the covered individual uses edu-11
53-cational assistance under chapter 33 of this 12
54-title to pursue the second such program. 13
60+MOUNT OFASSISTANCE.—(1) The Secretary 22
61+shall provide, to each covered individual who pursues a high 23
62+technology program of education under this section, edu-24
63+cational assistance in amounts equal to the amounts pro-25

67+vided under section 3313(c)(1) of this title, including with 1
68+respect to the housing stipend described in that section and 2
69+in accordance with the treatment of programs that are dis-3
70+tance learning and programs that are less than half-time. 4
71+‘‘(2) Under paragraph (1), the Secretary shall provide 5
72+such amounts of educational assistance to a covered indi-6
73+vidual for each of the following: 7
74+‘‘(A) A high technology program of education. 8
75+‘‘(B) A second such program if— 9
76+‘‘(i) the second such program begins at least 10
77+18 months after the covered individual graduates 11
78+from the first such program; and 12
79+‘‘(ii) the covered individual uses educational 13
80+assistance under chapter 33 of this title to pur-14
81+sue the second such program. 15
5582 ‘‘(c) C
56-ONTRACTS.—(1) For purposes of carrying out 14
57-subsection (a), the Secretary shall seek to enter into con-15
58-tracts with any number of qualified providers of high tech-16
59-nology programs of education for the provision of such 17
60-programs to covered individuals. Each such contract shall 18
61-provide for the conditions under which the Secretary may 19
62-terminate the contract with the provider and the proce-20
63-dures for providing for the graduation of students who 21
64-were enrolled in a program provided by such provider in 22
65-the case of such a termination. 23
66-‘‘(2) A contract under this subsection shall provide 24
67-that the Secretary shall pay to a provider— 25 4

69-‘‘(A) upon the enrollment of a covered indi-1
70-vidual in the program, 25 percent of the cost of the 2
71-tuition and other fees for the program of education 3
72-for the individual; 4
73-‘‘(B) upon graduation of the individual from 5
74-the program, 25 percent of such cost; and 6
75-‘‘(C) 50 percent of such cost upon— 7
76-‘‘(i) the successful employment of the cov-8
77-ered individual for a period— 9
78-‘‘(I) of 180 days in the field of study 10
79-of the program; and 11
80-‘‘(II) that begins not later than 180 12
81-days following graduation of the covered 13
82-individual from the program; 14
83-‘‘(ii) the employment of the individual by 15
84-the provider for a period of one year; or 16
85-‘‘(iii) the enrollment of the individual in a 17
86-program of education to continue education in 18
87-such field of study. 19
88-‘‘(3) For purposes of this section, a provider of a high 20
89-technology program of education is qualified if— 21
90-‘‘(A) the provider employs instructors whom the 22
91-Secretary determines are experts in their respective 23
92-fields in accordance with paragraph (5); 24 5

94-‘‘(B) the provider has successfully provided the 1
95-high technology program for at least one year; 2
96-‘‘(C) the provider does not charge tuition and 3
97-fees to a covered individual who receives assistance 4
98-under this section to pursue such program that are 5
99-higher than the tuition and fees charged by such 6
100-provider to another individual; and 7
101-‘‘(D) the provider meets the approval criteria 8
102-developed by the Secretary under paragraph (4). 9
103-‘‘(4)(A) The Secretary shall prescribe criteria for ap-10
104-proving providers of a high technology program of edu-11
105-cation under this section. 12
106-‘‘(B) In developing such criteria, the Secretary may 13
107-consult with State approving agencies. 14
108-‘‘(C) Such criteria are not required to meet the re-15
109-quirements of section 3672 of this title. 16
110-‘‘(D) Such criteria shall include the job placement 17
111-rate, in the field of study of a program of education, of 18
112-covered individuals who complete such program of edu-19
113-cation. 20
114-‘‘(5) The Secretary shall determine whether instruc-21
115-tors are experts under paragraph (3)(A) based on evidence 22
116-furnished to the Secretary by the provider regarding the 23
117-ability of the instructors to— 24 6

119-‘‘(A) identify professions in need of new em-1
120-ployees to hire, tailor the programs to meet market 2
121-needs, and identify the employers likely to hire grad-3
122-uates; 4
123-‘‘(B) effectively teach the skills offered to cov-5
124-ered individuals; 6
125-‘‘(C) provide relevant industry experience in the 7
126-fields of programs offered to incoming covered indi-8
127-viduals; and 9
128-‘‘(D) demonstrate relevant industry experience 10
129-in such fields of programs. 11
130-‘‘(6) In entering into contracts under this subsection, 12
131-the Secretary shall give preference to a provider of a high 13
132-technology program of education— 14
133-‘‘(A) from which at least 70 percent of grad-15
134-uates find full-time employment in the field of study 16
135-of the program during the 180-day period beginning 17
136-on the date the student graduates from the program; 18
137-or 19
83+ONTRACTS.—(1) For purposes of carrying out 16
84+subsection (a), the Secretary shall seek to enter into con-17
85+tracts with any number of qualified providers of high tech-18
86+nology programs of education for the provision of such pro-19
87+grams to covered individuals. Each such contract shall pro-20
88+vide for the conditions under which the Secretary may ter-21
89+minate the contract with the provider and the procedures 22
90+for providing for the graduation of students who were en-23
91+rolled in a program provided by such provider in the case 24
92+of such a termination. 25

97+that the Secretary shall pay to a provider— 2

101+dividual; 6
102+‘‘(B) upon graduation of the individual from the 7

147-to educational assistance under chapter 30, 32, 33, 34, 2
148-or 35 of this title, entitlement of the individual to edu-3
149-cational assistance under this section shall be charged at 4
150-the rate of one month of such remaining entitlement for 5
151-each such month of educational assistance under this sec-6
152-tion. 7
153-‘‘(2) The Secretary may not consider enrollment in 8
154-a high technology program of education under this section 9
155-to be assistance under a provision of law referred to in 10
156-section 3695 of this title. 11
172+FFECT ONOTHERENTITLEMENT.—(1) If a cov-23
173+ered individual enrolled in a high technology program of 24
174+education under this section has remaining entitlement to 25

179+of this title, entitlement of the individual to educational as-2
180+sistance under this section shall be charged at the rate of 3
181+one month of such remaining entitlement for each such 4
182+month of educational assistance under this section. 5
183+‘‘(2) The Secretary may not consider enrollment in a 6
184+high technology program of education under this section to 7
185+be assistance under a provision of law referred to in section 8
186+3695 of this title. 9

158-EQUIREMENTS FOR EDUCATIONALINSTITU-12
159-TIONS.—(1) The Secretary shall not approve the enroll-13
160-ment of any covered individual, not already enrolled, in 14
161-any high technology programs of education under this sec-15
162-tion for any period during which the Secretary finds that 16
163-more than 85 percent of the students enrolled in the pro-17
164-gram are having all or part of their tuition, fees, or other 18
165-charges paid to or for them by the educational institution 19
166-or by the Department of Veterans Affairs under this title 20
167-or under chapter 1606 or 1607 of title 10, except with 21
168-respect to tuition, fees, or other charges that are paid 22
169-under a payment plan at an educational institution that 23
170-the Secretary determines has a history of offering pay-24 8

172-ment plans that are completed not later than 180 days 1
173-after the end of the applicable term, quarter, or semester. 2
174-‘‘(2) The Secretary may waive a requirement of para-3
175-graph (1) if the Secretary determines, pursuant to regula-4
176-tions which the Secretary shall prescribe, such waiver to 5
177-be in the interest of the covered individual and the Federal 6
178-Government. Not later than 30 days after the Secretary 7
179-waives such a requirement, the Secretary shall submit to 8
180-the Committees on Veterans’ Affairs of the Senate and 9
181-House of Representatives a report regarding such waiver. 10
182-‘‘(3)(A)(i) The Secretary shall establish and maintain 11
183-a process by which an educational institution may request 12
184-a review of a determination that the educational institu-13
185-tion does not meet the requirements of paragraph (1). 14
186-‘‘(ii) The Secretary may consult with a State approv-15
187-ing agency regarding such process or such a review. 16
188-‘‘(iii) Not later than 180 days after the Secretary es-17
189-tablishes or revises a process under this subparagraph, the 18
190-Secretary shall submit to the Committees on Veterans’ Af-19
191-fairs of the Senate and House of Representatives a report 20
192-regarding such process. 21
193-‘‘(B) An educational institution that requests a re-22
194-view under subparagraph (A)— 23
195-‘‘(i) shall request the review not later than 30 24
196-days after the start of the term, quarter, or semester 25 9

198-for which the determination described in subpara-1
199-graph (A) applies; and 2
200-‘‘(ii) may include any information that the edu-3
201-cational institution believes the Department should 4
202-have taken into account when making the deter-5
203-mination, including with respect to any mitigating 6
204-circumstances. 7

198+or other charges that are paid under a payment plan at 20
199+an educational institution that the Secretary determines 21
200+has a history of offering payment plans that are completed 22
201+not later than 180 days after the end of the applicable term, 23
202+quarter, or semester. 24

235+cational institution believes the Department should 2
236+have taken into account when making the determina-3
237+tion, including with respect to any mitigating cir-4

206-NNUALREPORTS.—Not later than one year 8
207-after the date of the enactment of this section, and annu-9

209-section (i), the Secretary shall submit to the Committees 11
210-on Veterans’ Affairs of the Senate and House of Rep-12
211-resentatives a report on the operation of program under 13
212-this section during the year covered by the report. Each 14
213-such report shall include each of the following: 15
214-‘‘(1) The number of covered individuals enrolled 16
215-in the program, disaggregated by type of educational 17
216-institution, during the year covered by the report. 18
217-‘‘(2) The number of covered individuals who 19
218-completed a high technology program of education 20
219-under the program during the year covered by the 21
220-report. 22
221-‘‘(3) The average employment rate of covered 23
222-individuals who completed such a program of edu-24 10

224-cation during such year, as of 180 days after the 1
225-date of completion. 2
226-‘‘(4) The average length of time between the 3
227-completion of such a program of education and em-4
228-ployment. 5
229-‘‘(5) The total number of covered individuals 6
230-who completed a program of education under the 7
231-program and who, as of the date of the submission 8
232-of the report, are employed in a position related to 9
233-technology. 10
234-‘‘(6) The average salary of a covered individual 11
235-who completed a program of education under the 12
236-program and who is employed in a position related 13
237-to technology, in various geographic areas deter-14
238-mined by the Secretary. 15
239-‘‘(7) The average salary of all individuals em-16
240-ployed in positions related to technology in the geo-17
241-graphic areas determined under subparagraph (F), 18
242-and the difference, if any, between such average sal-19
243-ary and the average salary of a covered individual 20
244-who completed a program of education under the 21
245-program and who is employed in a position related 22
246-to technology. 23
247-‘‘(8) The number of covered individuals who 24
248-completed a program of education under the pro-25 11
249-•HR 1669 EH
250-gram and who subsequently enrolled in a second 1
251-program of education under the program. 2
252-‘‘(g) C
253-OLLECTION OF INFORMATION; CONSULTA-3
254-TION.—(1) The Secretary shall develop practices to use 4
255-to collect information about covered individuals and pro-5
256-viders of high technology programs of education. 6
257-‘‘(2) For the purpose of carrying out program under 7
258-this section, the Secretary may consult with providers of 8
259-high technology programs of education and may establish 9
260-an advisory group made up of representatives of such pro-10
261-viders, private employers in the technology field, and other 11
262-relevant groups or entities, as the Secretary determines 12
263-necessary. 13
240+NNUALREPORTS.—Not later than one year after 6
241+the date of the enactment of this section, and annually 7
242+thereafter until the termination date specified in subsection 8
243+(i), the Secretary shall submit to the Committees on Vet-9
244+erans’ Affairs of the Senate and House of Representatives 10
245+a report on the operation of program under this section dur-11
246+ing the year covered by the report. Each such report shall 12
247+include each of the following: 13
248+‘‘(1) The number of covered individuals enrolled 14
249+in the program, disaggregated by type of educational 15
250+institution, during the year covered by the report. 16
251+‘‘(2) The number of covered individuals who 17
252+completed a high technology program of education 18
